Can utility companies use my land without an easement?
I own property that has utility poles on the land however there is no easement for the poles. Are the utility companies granted easements without the property owners permission?
What can I build in a permanent construction easement?
I am trying to find the exact meaning of Permanent Construction Easement. Specifically, can I construct a fence, flowerbeds, and similar things in that area. And, if the easement is called upon, who then has to pay for the replacement of those things?
Can a landlocked parcel gain an easement through my property?
A parcel of land that adjoins land we own is being sold. This land is strictly timber and hunting ground so for many years the person who owned the land was able to get to his land by crossing a river/stream that is considered easy to cross and is shallow most times of the year. Recently we were told that this parcel of land is considered "landlocked" and the seller is claiming that the person he is selling the land to will have the right to an easement through my property. Is that true even though the land is accessible by another method (crossing the river) and the land is only used for hunting purposes?
Can a street become private without legal closure in North Carolina?
I purchased commercial property on a right-of way. It is on a map of the tract dated in 1924. There is an easement that is open to a major road and that easement has existed since 1935. The easement has been maintained by the State of North Carolina since 1935. The property changed hands by the sale of a company in 1982 and the property was sold to the city. The city sold the property to a church. Six months later the church blocked the easement. According to record, in 1989 the city did not accept the street with three owners, seven business locations to maintain and stated that the complete street became a private street. There was no 160A-299 form used. The county register of deeds has no record of the street becoming private. My deed implies that the street and road were shown on the plat. Can this be a private road without closing the street legally?
What does it mean if an easement is deeded as a lot line?
I had given an easement for a well but later found out that the party who was given the easement had been deeded it over to him as a lot line. Why, was it done this way and what is a lot line?
