Can a state take a homeowner's right of way without compensation?
Can your state department of transportation take the 20' right of way from the homeowner and widen the road without compensation?
Do we need to move our driveway that exceeds the easement?
Our home/land is land locked and we have a private easement (legal and documented) over a neighboring parcel. The easement is 24'; however the previous owners (builders) of both parcels did not survey the property prior to establishing the driveway. A survey has shown that our driveway exceeds the easement. The driveway has been in place since before 1996. We purchased the property in 2001 with the driveway already in place. Do we have to move it now? Can the owner of the parcel where the easement exist move the driveway without or approval or permission?
Can a seller sell a landlocked lot with an access easement?
I am in the Unincorporated section of Collin County. The Question is: Can a seller who owns a 40 acre tract of land sell a 2 acre lot that would be landlocked if it were not for an Access Easement to a public road? Also, could the seller sell the Access Easement to the person that bought the 2 acre lot or does this access easement run with the larger tract of land? Is it not saleable unless a person purchases the entire 40 acre tract of land?
Do I have rights over the gravel pad encroaching on my land?
I am purchasing land to use as a sales lot. The land that is adjacent to the land I am buying was purchased a little before mine by someone else. They received oral permission (from the man that I am buying my property from) to build their gravel pad a little bit on to the land I am buying. Well they have now turned that little bit in about 40' X 100' of gravel pad that is on the property that I will take possession of in a few weeks. This pad is still being built and won't be finished until after I fully own the land I am buying. Do I have any legal right since I knew of their encroachment before I purchased the land? Since the previous land owner give them oral permission does that mean I just lose that much of the property he is selling me?
Can I challenge a water district's refusal to transfer water rights?
We have used a water district's water in pastures for over 20 years. We sold the ranch last fall. The water district refuses to allow the new owner to use the water. They say they are not accepting new hook-ups nor will they allow me to let him use the water and charge him for the cost of the water. Would I have any chance to change their rulings in a court of law?
