Can I take legal action against a neighbor obstructing a private road?
main dirt road threw Hawaii subdivision is private rd., owned by man who does not own land in subdivision(only road). yet deeds state road is 40 feet wide for all owners to use. man at first of rd. has narrowed the rd. down to 10 ft. next to his house by placing large rocks along rd. he will not stop it, since rd. runs along his 6 lots so he thinks he has a right to do it. must i go to court since he will not stop obstructing the rd. since road is private police will not deal with problem.
How can I claim a drainage easement next to my property?
I have a drainage easement that runs next to my house property, the easement strip has been cut off because a block wall had been built for a condo complex at least ten years ago. There is a chain link fence that actually runs from the corner of the rear corner of my house to the block wall. How do I claim the property so I can build a block wall to secure my property?
What is the difference between an easement and a license?
I purchased property with the understanding I would be granted an easement to get to the property. It turned out, after the easement was granted and recorded, that the pipeline company had a right of way and they said my easement could not be used as my driveway. The owner of the land that sold me my property is going to give me another easement for my driveway. That is after I paid $2500. to have the new driveway put in with the pipeline engineers supervising it. Now he is trying, thru his lawyer, to convert the original easement to a license because I was able to get a letter from the pipeline company to grant me limited (in an emergency) access thru the original easement to my property. What is the difference between the easement and a license? I think I am getting taken advantage of. Help!
Can a neighbor walk their dog on my property easement?
We have a residence in Charleston County, SC (Johns Island). Our house/property faces a state maintained rural road. We are having a dsipute with a neighbor and her dog. She claims she may walk her dog on our property as long as she remains within the area of the easement. We believe easements are on private property but as an easement certain governments or utitlities may access for specific reasons but not private citizens for recreation or personal reasons. Can you advise? Is this treaspasing?
Can I hold trespassers accountable for crossing my hunting lease property?
I have a hunting lease, which i have owner authority for the 1250 acres of land for 20+ years an am responsible for the insurance, and upkeep and posting of property and keeping unwanted persons off the premises...On the back side of our property is 40 acres of timber and the owner of it rarely see it, but i have unwanteds come and go through our property damaging the cared for roads.The unwanted say they have permission from the owner of the 40 acres. We have had property stolen, and have expensive equipment on the property. Is there a legal check system, that can be applied to the owner of the other acres, and what about the persons, that say they have permission. Can they be held accountable for our upkeep,can they be required to show proof of permission to cross our property, and is the owner the only one that can come across. The property is located in White County AR.
