Is a right of way still valid after 40 years of non-use?
a right of way not being used for over 40 years, is it still valid?
Can my neighbor plant or grade on my exclusive driveway easement?
I have an exclusive driveway easement that has been surveyed and registered at the court house. I am responsible for all maintenance and upkeep does my neighbor have the right to plant on it or grade it.
What can I do if my easement access is blocked?
I am the last house on an easement. I own the easement. I am constantly being blocked in by guests worker etc. I have repeatedly asks the home owners not to do so with no satisfaction. What are my options? My ability to have unrestricted access and egress. Deliveries to my home are also some times interrupted.
Can the water supplier refuse to sell me water after 12 years?
I own a mobile home as a rental and have been buying water from a pvt. water system for 12 years. I am on a easement type road and the county will not run a water line to my property. A well is on my property but is contaminated so the system owner who buys water from the county and has a line running past my property is the only way I can get water. The seller without notice to me has cut the connection to my property and refuses to answer telephone calls and has not replied to a letter I mailed him. I went to his house and talked to his wife and she stated that he did not want to sell me water any more. The water line belonged to someone else when I bought the property 12 years ago and this guy took it over about 4 years ago. I have been paying the water bills they put in my mailbox without fail for 12 years. I think he has to continue selling water to me. What can I do?
Can I gate my property after combining two lots in Pennsylvania?
I own a 6 acre lot in PA, that is the second to last lot on a mountain dirt road. There was one more 7 acre lot beyond mine which was supposed to be a common area on which the road terminated as a cul-de-sac. When the developer tried to transfer the property to the owners association, they refused to accept possession of it because they didn't want to be burdened with the property taxes. As a result, the developer put the lot on the market and sold it as another private lot. I purchased the lot and had both lots combined into one deed. Would any easement across my first property be extinguished now that I own both properties (Unity of Seine), and do I have the right to gate off access to my property, providing I construct a new turn around area for motor vehicles?
