Do I need an heirs deed to sell my sister's house?
My sister passed away. Her will includes me, a dear friend and a sister-in-law (now deceased). I am the executor of the will. I want to sell the house. Real Estate Agent says I need a 'Heirs Deed'. I have the regular deed. Is 'Heirs Deed' another name for 'Affidavit of Heirship'?
Do the children have rights to property after their mother's death?
My father was married she passed away 8 years before him he was executor of her estate. He hired an attorney and probated her will in Solemn form in the probate courts in Georgia The probated will shows all her children wher notified and served 3 of the 4 signed 1 shows he was served two times by the sherrifs office never signed any paper work never contested in probate court. My father passed away and a property still had his name and hers on the deed. Do her children have legal rights to parts or all of this property?
What steps should I take to remove my deceased uncle from the property deed?
My uncle who is the co-owner of my property located in VA as a 'tenant in common' on the deed had passed away recently. He was a naturalized US citizen lived in CA. His wife and 4 children (above 18 yrs old) are the non-US residents and are willing to remove his name from the deed without any terms and conditions. He did not have a Will. His name was only on the Deed and I'm the sole borrower of the mortgage who takes care of each and every payment related to the property. What is the step by step procedure to complete this process?Please advise!
What is the time period for life insurance beneficiary claims in South Carolina?
My father passed away recently. He has a life Insurance policy but they said they have very little info on the beneficiary, as the policy was set up 12-15 yrs ago in another state. My father has lived in South Carolina for 11 yrs. If they don't find the beneficiary it will defer to the state. Is the time period for SC 3,4, or 5 years before it is deferred? Also how would I go about claiming it, as I am his next of kin?
How can I remove my deceased stepfather's name from the property deed?
this question is regarding property that I own in the state of Fl. that is in both my name and the name of my deceased step father (died 1986) what forms do i need to fill out to have his name removed from the deed. I have been paying all the property taxes since 1993. I left the title as is in respect to my mother but she passed away in april of this year so now I would like my name only on appear the trust deed.
