Can a check for a decedent's account be payable to the petitioner?
Can a check for the balance of a deposit account that was owned by the decedent be made payable to the petitioner's name presenting an order of summary administration or does the check need to be made payable to the estate of ______decedent's name?
What should I do if the executor of a will is incompetent?
My uncle died on May 9, 2009. I was told by him several years prior to his death that he did not have a will. Acting on the assumption that he had died intestate, I was appointed by the probate judge of Fulton Couny, Georgia to be the administrator of his estate. Subsequently, I discovered that he did, in fact, have a will which was prepared an properly witnessed and notarized in 1983. My question is what do I have to do now. The only difference in this situation is the appointment of the executor of his will. The executor named in the will is his wife who is the sole beneficiary. She is 91 and is incompetent to handle her duties as executrix, in my opinion Can you tell me the course of action that I should take in this situation.

Must a Personal Representative provide a Life Estate Deed within a specified amount of time? If so, what is that time limit?
Can the IBEW Local Union 728 require a release to access my brother's retirement funds?
My Brother died and the Retirement Plan, IBEW Local Union 728 Annunity Plan wants my sisters and brothers to sign a release , releasing them of any liability, before they will turn the funds over to the Estate of my Brother which I am in control of. This would complete his wishes per his will.
Is my wife entitled to her mother's funds without a will?
My mother-in-law died May 30, 2010. She was the sole owner of a checking account and a CD. Not sure of the mount of money involed but probably less than $40,000. There was no will or letters of aministration or letters of testamentary. My mother-in was married but my wife was her only his child. Is my wife entitleld with a death certifcate to any of the funds of these accounts.
