Which State Should A Power of Attorney Be Created For?
I am in the process of having my mom sign a durable power of attorney for financial and medical. My question is, her residence is still in California but she will be moved to Nevada soon, do I need a POA for both states or just one and if one which one? Her assets, bank accounts, property etc are all in California.
How Do I Revoke a Power of Attorney in Pennsylvania?
Currently there is a durable power of attorney which was in effect 3/2007. The person who has power of attorney is seeking to utilize resources and this approach is questionable as it doesn't serve the party's overall welfare. There are pre-existing monies to be released and we would like to revoke the power of attorney from 3/2007. The party is of sound mind and has expressed wanting his sister to have power of attorney moving forward. What should be the next step?
What can I do if I think my mentally ill father executed a wrong power of attorney?
My dad is 81 years old. I found out just 11/30/09 that he has appointed a non-family member as his Power of Att'y in the state of Georgia. My dad had some mental issues over Thanksgiving Holiday, I called his friend to see if he had knowledge of the mental condition that my dad was having...His friend still has not return my call. Later, I found out that he was my dads Power of Att'y... when I call dads family doctor to get my dad scheduled for a exam.
Would an executor lose his house if the medical bills of his parents couldn't be paid?
My husband is power of attorney from state of MI for his parents his dad has Alzheimer's and his mother had a massive stroke, and has some brain damage and not able to make financial decisions. My husband and our two daughters are the executors of the estate if and when they die but until then if they run up medical bills and take a lean out on there home that is in MI to live here in TN when that money gone all they can borrow on home in MI and then if they die are my family responsible for the debts and leans they borrow against . Can they come or sue us I don't want to lose my home over this to keep them up in a place they can't afford. What do we do? We live in TN and have my in-laws in a asst living here in TN but there home is in Michigan ?
What can be done to enforce a durable power of attorney?
I have Durable Power of Attorney for both of my relatives. Also, I am the Executor of both Wills. I was told by Chase Bank that no one can change their or alter the annuities in anyway except the owners of the annuity. Both of the owners have been certified by their physicians that they are unable to make such decisions. Is this true? The male wants to leave his to the housekeeper not his wife. Thank you.
