Will I face penalties for breaking my lease due to health reasons?
I live in Colorado, but the weather is bad for my health. My question is, if by a doctor advise it would be good for me to move to another state, will I be penalized by breaking up a lease contract?
Can I give a 50-day notice to my landlord for my apartment?
The lease on my apartment is up and I am due to sign a new lease for my apartment however I am moving to a new townhome. My manager said she needs a full 60 day notice and will not except it today (the 9th of the month) because it is not the 1st of the month, If I give my notice today it will be a 50 day notice. I don't have a current lease signed so can they go after me for a full 60 day notice? Will I have to wait the end of the month to give the notice and get stuck with an additional month of rent?
What are my rights regarding a lease mistake by my apartment community?
My wife and I have lived at the same apartment community for two years. We are moving and have hit a problem that we need legal counsel with. Our first 12 month contract we signed was from June 1, 2005 - May 30, 2006. When we were given our second contract, the apartment community made a mistake and dated it for July 1, 2006 - June 30th 2007. We didn't see the mistake and we signed it. This totally skipped the month of June, 2006.
We have been planning on moving May 30th of this year (thinking that was when our lease was up) but it was brought to our attention by the apartment office that we have to pay through June 30th. The leasing office has agreed that it was THEIR mistake but that we are legally bound until June 30th and they don't seem willing to work with us. The way I look at it (and am wondering if it would hold up in court) is that if they want to read it that way, then legally, we were not contracted to pay for the month of June, 2006 (which was lost in between the lease agreements) and therefore, should be reimbursed the amount for that month. What should we do?
We are double paying for one month already on our new place and this community, and this will make two months of double paying, which in Southern California is extremely difficult. Any advice would be highly appreciated!
Am I responsible for lot rent without giving written notice?
In my trailor park, the lease on the lot states that I must give a written notice of moving in 30 days, My lease was up in Feb. I moved in March 19th without giving a written notice am I still responsable for the March and April payment the owner states that I have to pay the lot rent because she never got a written notice. Is this true, do I have to pay that?
What notice is required for month-to-month tenants after a home sale?
I currently reside in Berks County Pa. I rent the larger portion of a 2 unit apartment building that is being sold. I had a one year lease that expired in Feb 05. Since that time we have had an ongoing oral month to month lease. Our landlord had told us that he was putting the house up for sale but would make sure that any buyer would be willing to honor our lease. Recently we have been emailed stating that he has signed a purchase agreement for the house and that the new owner wants to occupy the unit that we are currently renting. My question is what type of notice do we have to be given can it be by email or is he required to send a registered letter? Also how much notice does he have to give us if we are on a month to month lease and being asked to leave due to the sale of the home? Does the notice have to be given on the 1st of the month to move by the following month etc? Also what happens to my security deposit, if the sale goes through before he refunds it? There is nothing in my lease to answer these questions I have read it several times. We have put up with having a lock box put on our front door without our permission and agents entering without calling in advance and when we have been given notice its usually only 4-6 hrs. We normally would not have a problem with this but we have 3 young children 2 of which are currently enrolled in school and can not find another home in the area, even if its above our price range.
