Can my landlord keep my deposit after a 7-day notice to vacate?
I stayed in a duplex in Redwood City. I didn't sign any lease but the verbal agreement was a month to month basis. I stayed there for 2 months but I have an emergency so I have to leave for TX. Of course I paid a deposit equivalent to a month's rent of $1200. I only gave my landlord a 7 day notice to vacate the premise. Is the landlord entitled to keep my deposit even if I left the premises ready to move in? Am I not entitled to get back my deposit?
Can we evict tenants for having an unauthorized dog in Nevada?
We are renting our house in Nevada to a couple who have a dog, and our lease states no pets allowed unless written notice from Landlord (Us). They agreed stating that the dog would stay with her parents. We found out however from our neighbors that the dog has been their the whole time!
Our management company went over there to investigate and sure enough the dog was there. Our management company seems to not mind the dog being there because it stays in a kennel. However, this is our home and we are trying to sell it as well, and we choose not to have any pets .
They breeched the contract and never let anyone know that the dog was there, what kind of eviction notice could I give. Give the 10 days to remove the dog and keep 100% of the deposit for the violation?
If they refuse to give up the dog and move, can I request them to pay us the remaining balance of the lease plus keep 100% of the deposit for the breech?
Can my landlord unreasonably withhold consent to sublet my apartment?
I am a tenant in a residential lease in California. I notified my landlord verbally that I would like to terminate my lease 30 days early due to family difficulties requiring me to relocate (I also gave my notice in writing 30 days before I wished to terminate the lease). My lease specifies that I may not sublet without consent and that I may not use the security deposit to pay the last months rent. My understanding is that if I provide a ready, willing and able party (with no legal reason for the landlord to deny leasing to the party) to rent the apartment starting when I move out, that the landlord may not charge me for the last month of rent.
The building manager is refusing to allow me to do this. I would like to mitigate my financial damage as much as possible. The building manager is also refusing to allow me to speak to the owner of the building (who is responsible for making these decisions).
When does a one-year lease end if it starts on May 20, 2006?
If I move in to an apartment on May 20, 06, when will my one year lease end? Is it legal for it to end on April 10, 07?
Can a landlord charge for the entire month of April after a 30-day notice?
If you turn in a 30 day notice on the 22 of March can the landlord charge me the whole month of April?
