Can we terminate our lease due to flooding and mold issues?
We just moved into a rental on February 22, 2007 from the state of Indiana. The home is a raised ranch with a 3/4 finished basement. The basement has a spare bedroom (carpeted) and a family room with a bar (carpeted). On April 14th we had a severe storm and the spare bedroom downstairs and partially into the family room flooded to the point there was about 2 inches of water.I called the landlord immediately on the 14th. She returned my call on the 15th and stated they would have to turn it in on their homeowners insurance and not to do anything until insurance was notified. Since the 15th I left messages for her several times and still have not received a call or anything from anyone. We now have a severe ant problem in the basement and a major odor. (mildew smell) and mold forming from the wet carpet. We signed a 1 year lease. Can we get out of it? We have a 10 year old daughter who has severe allergies to the point she is now on medication since all this has happended.
Can I sue my landlord for illegal entry and privacy invasion?
I signed a 1 year lease with my landlord about 8 months ago, which he just gave me a copy of. Recently he has gone into my home without my permission and went through my home checking things out. The lease states that he needs to get my permission to enter the premises in a timely manner (which he did not). He told me that he "owns" the place and he can enter any time he wishes. To me this violates my privacy. Can I sue him for illegal entry or charge him somehow for invading my privacy?? This guy is a bully. Also when he gave me the lease I saw where he and his wife wrote things in there "after" i signed it back in September of last year. And copied my signature to the lease HE made out and took out clauses from the original that can be clearly seen. The landlord also "waived" the security on the beginning and now that the lease is almost up, he's damanding the security. (this was verbal)
Can landlords force tenants to move out and show the property without notice?
My daughter had just started renting a house 3 months ago. She lives with here fiance and her two children. They where suppose to rent it for a year in option to buy. The lease was made out for month to month. Just recently they came to her and ask if she would pay $900.00 instead of $850.00, if they would not agree to the terms they were going to put the house up for sale. Well of course my daughter said no. Now they are calling leaving messages when they are not at home (and they know they are not home) saying they are going to show the place on Thursday and they have to be out between 6-9. Then they call and say they are (landlords) going to move back in. Then they told them they have 30 days to get out. Not speaking to them personally or with a written notice. Can they do this when she has a 10 month old baby and a 3 year old daughter? They are tried of moving and expected to stay there, until either they could buy that property or another property. We also think they are entering the property with other people and showing it without them being there or letting them know they are coming.
Is snaking sewer drains a repair or a safety issue?
I am in a rental lease for 1 year. There is a clause that states that I must pay for any repairs that fall under $250.00. I had to call a plumber to snake out my sewer drains that lead to the main one outside. He pulled out a couple of handfuls of tree roots. I need to know if this is considered a repair or does this fall under a safety issue since it was coming up from the outside pipes and when the toilet was flush or water was ran it would cause a back up in the drain.
How often can a landlord show a rented property for sale with notice?
What is the reasonable amount of times a landlord can show a rented property up for sale and also do they need a legal 24 hour notice?
