What should we do about our neighbor's fence encroachment and driveway dispute?
We recently had our property surveyed and found that our neighbours fence crossed onto our side of the property line, she had it built about 5 years ago. She offered to have it removed after the survey was done and surpisingly to us when we agreed it should be removed she retaliated and told us she wanted less than 2 sq. feet of our concrete driveway removed which lapses onto her side, it has been down for 20 years and was put down by the contractor who built both our homes. What is the best solution for us?
Can my neighbor connect to my fence without permission?
If my chain link fence is recessed 4' into our property, does my neighbor have the right to connect to my fence without my permission?
What are my options if my house encroaches on a neighbor's land?
We built a house in February 2006 and thought that it was on the property line. We had ask the surveyor to survey. Now we find out that the person who surveyed our lot did not go all the way to the flag which is still there on the corner of the lot. We are now being sued for $20,000 plus $60,000 for punitive damages for our house encroaching 32.3 feet on the corner of his land. We had no idea when we built the house that this was the case as the surveyor did not flag anything or post any type of markers at that point. This land here is about $2500 per acre. How do we solve this problem? We do not have funds to pay them if they were to get this settlement. The total square footage in dispute is 521 feet. Does the court rule in favor of such greed as this is or will we be asked to pay the current land value?
Can we require our neighbor to complete their fence for our property access?
In April (2007), we had a fence put up in our backyard that is indented 6 inches inside our property line. Last month our neighbor put up a fence that is identical to ours, but did not totally enclose his backyard and is therefore benefiting form our fence. They say because neither of the fences are ON the property lines what they are doing is legal, they also do not feel they should compensate us in anyway for our fence assisting in the enclosing of their backyard. They say they do not see how they are benefiting from our fence. We do not want money, we simply want them to complete their fence, because now 6 inches of our property is in their backyard, and we do not have access to it. We are worried about any liabilities this can cause, and if there is any future damage to the fence we will have to pay for it. Is it worth taking them to court? Are they in the wrong?
What should I do if my neighbor refuses to trim hedges on my property?
A neighbor has a hedge that originally was planted on his property several years ago. He let it grow out where it is clearly on my property. I have asked him many times to trim it back, and he refuses. I showed him a copy of my survey and showed him the property lines. He even had his land surveyed when he applied for a remortgage. I asked him again that while the flags were showing the boundary if he would trim them. He again refused. I went to the town hall and asked them to verify my property boundary, and they agreed with me, and said I had the right to trim his hedges if they were on my property. I sent him a letter, stating that I would appreciate it if he would trim the bushes or I would have to. He came over and screamed at me and said he would have me arrested it I touched his bushes, yet he's been hacking one of my bushes that I've had (on my property) for 13 years so his plants have more room to grow. I called him last night and said I was really getting stressed out over the whole matter (I want to sell my house when the market gets better, and I'm afraid that there will be a problem when it is surveyed for the new potential owners. I tried to offer that we could hire an independent surveyer, and if he was not on my property I would pay for the survey, and if he was encroaching on my property he would pay for the survey and cut his bushes back. He started screaming at me and I finally said if he didn't cut them, I would. He called the police on me, and they came over and said I could be arrested if I cut his bushes. (Why can he hack mine on my property and not be arrested? Oh, yeah, he owns the landscaping company that takes care of his lawn, and they cut them, not him himself). What is the next thing I should do since we can't work this out amicalby?
