What can we do about a neighbor's garage encroaching on our property?
My wife and I are attempting to sell an inherited lake property in LaGrange County, Indiana. The potential buyer had the property surveyed and found the corner of the neighbors garage roof encroaches on our property by 4 inches. This was not previously protested by the deceased. Seems petty to me, but it is holding up the sale. What can I do to get the sale moving as I was laid off.
What steps can I take to remove my neighbor's encroaching fence?
My neighbor encroached on my property in two places creating a situation were we do not have access to that part of our land. They were informed prior to putting up the fence that our property exceeds a stockade fence that we have and they were informed by our lawyer, two weeks ago. They have done nothing: contacted us, the lawyer or taken it down. What is the sequence of events to get the fences removed?

This is about encroachment on my property from a neighbor... i have bought a house in Silver Lake LA in 2008. and found out after purchase that there may be an issue of encroachment according to my architect--the neighbor on the side of my driveway has used approx three feet of my land to build a concrete staircase from side walk to access their side door; which in turn completely blocks any potential access from my drive way to the back /kitchen door which is located on the same side of the driveway. In order for me to access my house, I have to use the front door that's accesible only with stairway; OR walk around the entire outside perimeter of the house to get to the backdoor; which is at times troublesome and inconvenient. I am also deprived the use of appro. 3 feet of space in the back yard which would leave potential for access to the backyard from another way. The neighbor just informed me he is selling his home. I thought it would be a good time to bring up the issue for discussion. I am hoping for a fair and amicable resolution. I am hiring a surveyor at this time, what's your advise for my legal rights to my property? What do I have to do to proceed to file a claim ? What needs to be done next? I have called the neighbor who is an attorney, he said to let him know about the result of the survey. Should he share the cost of the survey in case there is in fact an entrenchment as the estimate is $1900? Should I also bring this up to his realtor? I wish my had brought this issue up at the time of my home purchase.Your advice would be appreciated. Thank you.
How can we resolve a long-standing encroachment without moving the building?
An encroachment appears to have existed for a very long time. How do we resolve it without moving the small building that straddles two properties? am a realtor in CA involved in a transaction, as a realtor and as the buyer, where a small building on the property being purchased straddles the adjoining property.
Can I remove a woodshed encroaching on my property?
I have a neighbor who is encroaching my property. This is confirmed by my survey, and hers as well (I have copies of both) There are some partial encroachments, as well as a woodshed that fully sits on my property. I have asked her many times, both verbally and in writing, to remove the encroachments or settle with me via a boundary line adjustment and property swap. She refuses to answer any of my requests / offers but has also not initiated a claim of adverse possession. (This has been a known issue for three years now) I live in a very rural area of the Adirondack Park, and the local Judge would have to recuse himself were I to take this to small claims. Legal representation as I moved up the chain of the courts to find a judgement would be costly. If she or one of her tenants injures themselves while storing or moving firewood on my property, I'm afraid I would be liable.I want to shake this situation up and at least remove the shed myself. I would stack her wood for her on her own property edge. Am I within my rights to remove the shed? She is living out of the area at this time, but her caretaker, who sides with me in this issue, is more than glad to see me move the shed and wood, and will allow us access to her property to re position the shed. What is the downside of just moving the woodshed?
