How long until my son's juvenile record can be expunged?
My son was tried as a Junvenile, in Jefferson County, and entered into a plea bargain that if he did good on his probabtion, everything would be go away. He was accused of raping a girl, who was 14 and he was barely 16 at the time. He did not have sex ual intercourse with this girl.... but did have consensual oral sex. He was on house arrest for so long that he couldn't stand it anymore. So he took a plea, instead of going to court with his case, and was then placed back under house arrest for the probation period. Anyway, the question is this? How long do we have to wait to see if the courts will allow expungement of his record? When the judge revoked his probabtion because he wasnt obeying everything....he said it would only be a few years, but his says 5. Also I was told by 1 lawyer that he didn't know if his record could be expunged or not? My son is now 21, and this happened when he was 16. Also, he was on house arrest for a year and a half, it was crazy....and the Junvenile dept sent a letter releasing him off Sept/2009. He is not a sex offender and yet has now had to file as one. I was told back then that we could get his record expunged, but now I am scared as this one lawyer said he is not sure John's record can be expunged. There is so much too this, I wish I could do it all over again and go to trial. John had witnesses there with hm and everything, he just got worned down by the house arrest. The Junvenile dept wouldn't even let him leave our house with us, his parents. It was crazy. My son's name is John E Moore DOB 5-4-1990.
Did I harm my case by consenting to a police search after a warrant?
The police served a search warrant on my house. The warrant clearly states that they were looking for a stolen computer and anything associated with it. During the initial search they found a duffel bag with a large of amount of drugs. (marijuana) They returned with the bag and asked me if i consent to search the house for more stolen merchandise or drugs. I gave them consent. I wasnt arrested, they said they would get back to me. My question is, did i screw myself by giving them the consent? And if the warrant specified this computer, and the computer was located in plain sight on the kitchen table, did they have any right to continue searching my house? And can they now charge me with the drugs?
What can I do if my deposition was filed incorrectly?
My deposition was taken in a case I was not a party to. I was not represented by a lawyer. The deposition took two days, and the lawyer taking the deposition said she may need more time. The lawyer for the other side reserved the right to cross examine me. I reserved the right to read and sign the deposition. Out of the clear blue, my deposition (unsigned) was filed in the court records. What I had said was paraphrased incorrectly to the Judge which he quoted. Using this bad information he came to an incorrect conclusion in a summary judgement. I complained to the Florida Bar about this attorney unethical behavior. They said this was a judical matter, nothing they could do. The judge said for me to consult an attorney. What can I do to have my deposition deleted from the court record or get relief?
Should I disclose my expunged burglary record to future employers?
I was seventeen years old when i got arrested for a simpel burglary charge. this took place in nineteen eighty seven. i served three years probation and my parole officer told me after i completed my term i could check no on the application. I tried that but didnt work, so later i got my records expunged. i started working for a sheriffs office for four and a half years till i resigned. i changed my mined on resigning but they ran another background on me and found my okd mug shot. There was no recored with it just the picture. I dont know if they were going to let me go or not but i decided to go ahead and resigne. Later i tried to get work else where but never could. Even though had openings and I made all the requirments never got any job. I asked why but they would never give me a good reason. I had a friend run another background on me and it came back clean. I think my past employer might be telling them about the old record. the funny thing he hired me back but only part time and in at the jail now. i want to know would it be best to tell future employers about my past or what and what can I do to proceed with my carere Respectfully Vernon
Can someone be arrested for depositing a counterfeit check for a business?
how can someone makes a deposit for a company and the check was counterfiet ,and the preson that made the deposit name isn't on that business account be arrested when the owner sign the back of the check and ask him to make the deposit
