What does signing an affidavit of heirship mean for property rights?
My mom left no will, but stated that she wanted my sister to stay in the house. Taxes are due, my sister is diabled, so she would get a exemption. The tax office wants me and my brother to sign an affadavit of heirship. What does this mean if we sign this form? Are we giving up our rights to the property?
Can a Grant, Bargain, Sale Deed affect community property rights in Nevada?
When a Grantor executes a 'Grant, Bargain, Sale Deed' of real property to a spouse (Grantee) in Nevada and deny the Grantor of any subsequent community property interest in that property in a subsequent Nevada divorce between the two parties? Other words, does Nevada Community Property Law override or disregards such Grant, Bargain, Sale Deed?
What type of lawyer can help with mortgage company issues affecting credit?
My mortgage company has mishandled my account, which caused my credit report to be damaged making it impossible to refinance. I attempted to rectify this problem by contacting the mortgage company numerous times with no success. They either could not figure out the problem or transferred me to the incorrect group. I have kept records showing when I paid my account but they still could not explain incorrect billing issues. Additional information is available regarding this matter. What type of lawyer handles these kinds of cases? Do I have a case?
Can a judgment creditor place a lien on our homestead legally?
My wife had a business debt which was over $100,000 which she was sued for, she filed bankruptcy and received poor legal advice. The bankruptcy filing was denied because it was said she failed to produce accurate business records....it was on the advice of the attorney that she did not produce the records (she had them). At any rate after losing the bankruptcy, the guy suing her was granted a large judgement. This was several years ago, recently, my wife and I were attempting to secure a home equity loan against our homestead. We were surprised to find that there had been a lien placed against our homestead by this man and we could not secure the loan due to this lien and could only do so if the man would subordinate his lien. Is it 'legal' that he was able to do that? What could we do to find out and what can we do if it was not 'legal' that he placed the lien?
Does my son need the prosecution to examine items before court?
My son who will be standing trial for burglary and theft of property, in Brevard County. Although, he has fired his Court Appointed Attorney he is attempting to Subpoena Duces Techum issued reuiring my appearance at court. He wants me to bring his laptop, monitor and a VGA(?) Does this stuff have to be examined by the prosecution first? How do I get it to the prosecution?
