Can a bail bondsman post a bond for letters of administration?
Acting PRO SE I have received an ORDER APPOINTING PERSONAL REPRESENTATIVE for my deceased son. The order requires that I post a $10,000 bond before LETTERS OF ADMINISTRATION can be issued. Can an ordinary BAIL BONDSMAN post same or is a different source required?
Do unpaid medical bills affect the estate in Arizona?
Does unpaid Medical bills count against the estate- even though they will be paid later by Medicare and/or BlueShield? Please answer the question according to AZ law. My mother died and has very large unpaid medical bills but we need to know if those amounts will be subtracted from her estate total. We would like to qualify for 'small estate' status in AZ - What is the maximum amount the estate can hold?
Do I need to go through probate after my husband's death?
My husband died April 1, 2009. We had wills and powers of attorney done in Mississippi 4 years ago. We have 2 homes with mortgages and both our names are on these. His name is not on any other property or investments. Do I have to go through probate, file, or present the will in court? The combined worth of both homes is approximately 300,000 with 150,000 mortages.
Can an estate collect a loan from an heir during probate?
Looking for a statute in Wisconsin regarding collecting on money given to an heir marked 'loan' or not marked as gift that was never paid back to the deceased. Estate is in probate. Looking for any caselaw where, in such a situation, the personal representative won a money judgement for the estate against the heir. Must apply to Wisconsin. Need solid support because heir will argue debts were paid, yet no documents exist showing debt was paid in full. Heir is dishonest and will create receipts and forge signature and pass them off as legitimate. Please point to appropriate case name and any applicable law. There is a WI statute about heir owing debt to an 'intestate' estate. However, this estate had a will dividing property 50/50 between heirs. If heir #1 who owes money does not pay, heir #2 will receive nothing. Heir #1 received more than his share while dad was living, and papers found indicate dad intended these as loans, not free cash. Heir #1 also did not report all the monies as income on his tax return - cash received by him (there is a paper trail) are in excess of $90,000.
What should my dad do about his inheritance after my grandfather's death?
My grandfather passed away 6 weeks ago and my dad is estranged from his step-mother. My dad was not able to go to the funeral which was in another State. My dad knows he was in the Will but nobody has contacted him yet. What can he do. He will not call his step-mother and does not know my grandfather's attorney's name.
