What happens when my Husband's Will is dated before we married?
My Husband and I married 5 years ago and have one child born after our marriage. Last month my Husband died and a Will was discovered that was dated before our marriage leaving property to his children by his first marriage. Neither I nor our child is mentioned in the Will. We have not found another Will and I am not aware that he made one. We live in Florida. What are my rights?
How do we find heirs of a deceased and who do we look for?
A friend in Florida recently died and had a substantial estate. No one knows if she had any children or other heirs. How do we find out if there are any heirs and what potential heirs should we look for in this situation. She did not have a Will.
Does a Father whose parental rights have been terminated have inherit rights from Son?
My son recently died in a traffic accident. I has not had a relationship with him for some years and 1 year ago my parental rights were terminated. I would like to know if I still have any right to inherit from him.
What happens if there is property that does not pass under a Will?
My Father made a Will and it he he provided that certain property go to certain children. However, he did not list all of his property. The estate lawyer also tells me that there was not "residuary clause" in the Will and therefore some of his property that was not mentioned does not pass under the Will. What does that really mean? We all live in Florida.
Is a provision in a Will that disputes must be arbitrated valid?
I have never heard of a Will that required any disputes between beneficiaries and/or the personal representative of an estate must be arbitrated. My Mother is heir under the Will of he Father and my Grandfather. She has four Brothers. When the Will was read it contained a provision that required any dispute to be arbitrated. My Mother believes the Will is invalid for technical reasons and also believes the Sister appointed as the Personal Representative of the Estate should not be removed because she misused money under a Power of Attorney after she was appointed by my Grandfather. Please help. He lived in Florida.
