What does bankruptcy of our developer mean for our HOA in North Carolina?
I'm in North Carolina. I live in a planned community and the bank has started foreclosure proceedings against our developer. It is our understanding the developer has started bankruptcy proceedings in response. Since our developer is still in control of our HOA...what does this mean to us as a community?
Can my neighbor's pool drainage be considered a nuisance or trespass?
My neighbor behind me built an in ground pool that doesn't have a cover. During the fall and winter it accumulates the rain and snow. The additional water is eventually released from the pool by way of the pump. The water then travels from the back of the lot to the front on my neighbors land that is next door to me. As it reaches the front it eventually pours onto the sidewalk where it suddenly begins to bottleneck. The bottleneck is caused as a result of the grass area along the curb that slows it down before running into the street. At that point it starts to back up on my front yard. Also, during the freezing weather my sidewalk turns to ice. The sidewalk is owned by the home owners association. Once the water touches my property directly from the sidewalk is that a violation of encroaching on my property and is the icy sidewalk a nuisance. What rights do I have, etc.
How can we sell our half of the duplex separately?
We bought a home 5 years ago -1/2 of a duplex. These duplexes used to be part of a condominium association many years ago. The original property owner of several of the condos died and the association officers just let the association dissolve. There was no record of a formal dissolution in the register of deeds when we purchased our home. Our duplex neighbor used a real estate attorney to separate the building - not the land. We are going to sell our property in 2010 and need advice about how to make sure our property can be sold separately from the other duplex. Would the legal action our neighbor took serve our needs, as well?
How can a husband transfer a house title after his wife's death?
Here is the situation: The name on the house title deed is husband & wife. The wife has died and the husband wants to change the title to his name & his son. Obvisously the wife can't sign for anything. How do you go about that?
Can I be held liable for my ex wife's foreclosure in Florida?
My Ex wife is being foreclosed on her home. I was still on the deed so when she refinanced it I had to sign off on it but did not sign the promissory note. I have since been deeded off the property. Can they still find a judgement against me? (Florida)I have been listed in the complaint.
