Is the HOA responsible for drywall damage from a leaking skylight?
the DOC's state the HOA is responsible for 'roof maintenance, repair ...' . I have mold growing on my ceiling as a result of a leaking skylight. Since the HOPA failed to even communicate with me I had to get the DBPR in Tallahassee involved just to get the leak fixed. Are they also responsible for fixing the damage to my drywall as a result of 'failure to maintain' (the roof is at the end of its lifespan) ? I am aware that FL does have a different approach to damage to other peoples property.
Do I control recreational access to rented land?
When renting land do I have control over who gets access to use it recreationally etc.
Can the bank take my truck or IRA if I short sale my home?
I have a mortgage of 98k here in florida. If I short sale my place can the bank try to take my truck? Or take money from my IRA to recover what i owe? What if there is a second name on the truck title and IRA?
Can a deed naming a defunct school be used by an unnamed church?
Can a deed that names a school (that no longer exists) as owner be used by a church that is not named in the deed and has never been transferred to the church?
Which lien has priority on insurance proceeds, vendor's lien or attorney's lien?
I have a land contract on a house that burned down. The vendee took the insurance company to court when they refused to pay. The court awarded a small sum to the vendee. Not enough to rebuild. Vendee now has a bill with his attorney who is sure to claim an attorney's lien on the proceeds. My question: which lien takes precedent on the proceeds, my vendor's lien or the attorney's lien?
