What can we do about a neighbor's garage encroaching on our property?
My wife and I are attempting to sell an inherited lake property in LaGrange County, Indiana. The potential buyer had the property surveyed and found the corner of the neighbors garage roof encroaches on our property by 4 inches. This was not previously protested by the deceased. Seems petty to me, but it is holding up the sale. What can I do to get the sale moving as I was laid off.
Can I file a small claims court case against my co-op board?
I plan to file claim against my co-op board in small claims court, to seek reimbursement for fees I paid them that were basically extortion and abuse of power. Is that legitimate? Also can emotional distress and harrassment and/or defamation be heard in the same claim, as long my claim is below $5,000, the limit in Small Claims Court? Should I wait and file separately for the harrassment etc?
Can my dad owner finance our home despite his existing loan?
My parents got our home loan and lived with us for a couple years until they built a smaller home on the same property. Due to my husbands previous marriage and his x wife's failure to get a home in Vegas out of his name, we cannot qualify for the loan. The loan is in my dad's name but we need to somehow get the home in our name for tax purposes and to protect him. Can he owner finance for us even when there is a loan in his name?
What rights does a trust representative have in an HOA?
Our home is in a trust. We belong to an HOA. My father is administrator of the trust. He has assigned me (his daughter) to represent the trust with the HOA. As the representative, I feel I should have all rights of any homeowner such as being on the board or holding an officer position. What statute should I use to force the board to accept the representative of this property with all homeowner rights? Also, if the board does not accept this representative, do we have to pay homeowners dues? (Taxation without representation?)
How do I release a lien after HOA foreclosure on a timeshare?
If time share was foreclosed by HOA, how do you release the Lien initially recorded, when the HOA insists that the Affidavit and recording of the deed is all that is needed to release the lien? We are presently in escrow on another property and it is being jeopardized.
