How does adverse possession affect my land ownership in Missouri?
I just bought land in Collins Mo and had it surveyed. This showed that one neighbors driveway curved into my land. Driveway is about 5 years old. It also shows a cattle fence cuts across one corner of my land by about 100 x 300 feet. I don't know how long its been that way. My question is how does adverse possession effect me as the new owners? I know it is 10 years in this state but does that start with me or the old owners? Land has never been surveyed before I had it done. Do I own all the land or does the cattle farmer own the corner of my land. What do i need to do to keep all my land? My deed is Fee Simple. Also does that mean I own the mineral rights to the land too?
What can I do about a property encroachment claim?
I received a letter from a lawyer of a property owner stating I am encroaching on his property behind my house what it looks like from the enclosed map 20 ft onto his property with my fence and shed. I have been living here for 20 years and bought the house with the shed and fence in the location its in now. The lawyer wants me to sign this legal letter stating I acknowledge my encroachment and move my sheds. I don't feel I am on any one's land nor have I ever had anyone come to me saying it was their land nor when I bought the house there was anything telling me where my property line was. The back of my house is an outlet for the sewage system and I always thought this land was owned by the county. What can I do to protect myself? I don't think I should move my sheds and fence. Can I claim this land? Do I have any rights here?
What recourse do we have if we lose a land lawsuit?
Our family has a pending civil lawsuit regarding some land that we have been paying taxes on for over 50 years. The family adjacent to us is stating that the land is overlapping and that the land belongs to them. They have not produced any proof. However, if the judge rules in the plaintiff's favor what further recourse will we have?
