Can I Recover Property Sold to Others to Avoid Me Collecting on a Judgment?
I'm considering filing a judgement against an individual who owns me money for an unpaid loan. This individual owns commercial properties which he is selling to family members and friends. He is selling the commercial properties for the balance due on the mortgage of the properties, which is considerably less than the fair market value of the properties. If I were to file a judgement against this individual and he claims not to have any money or assets to pay me, do I have any recourse against the individuals who purchased the properties for less the fair market value?
How Does the Court Conduct a Sale of Property in a Partition Case?
I am an owner of one-third of irrigated agricultural land in Nebraska, which three of us inherited in equal amounts. One sibling who has plenty of cash wants to purchase the property, but doesn't want to pay a fair market value for the land and will not agree to a public auction, or make an offer. I am being pressured by my brother, and my own attorney to quickly participate in a private auction between the three siblings, . I would need time to get a loan in order to make an offer. Since land values flucutate widely and are on the rise, it is difficult to obtain an an accurate appraised value. If my brother files a petition for partition, will the court accept an offer on one appraised value? What if two parties are interested in buying it? If it is sold by court order, will it be properly advertised then auctioned in order to reach a fair value? Should I get another lawyer, since I am not feeling very comfortable with mine right now.

State of TX: Bank Foreclosure...Can a Hearing on a Foreclosure take place, if the Home Borrower is Never notified by the Court System, that the Trial is to take place? And, is it Legal for the Home Borrower ,to be Notified 1 mth. and 11 days, AFTER the Proceedings took place & a Judgement found in the Lenders favour? Also, can the Bank take procession, after the court documents are sent to a PO Box # ...Even thou, the Lender Knows the Borrower physical address? And, must a Sheriff Serve papers, to the Borrower, stating ' that the Foreclosure is set for a certain date?
What Can a Condominium Do About a Lien From the Builder?
I have a mortgage on a condominium in South Padre Island, TX which I would like to re-finance. I just discovered that the builder has a lien which was not revealed to myself or probably any other owners. I now am having trouble doing the re-finance because of the lien since the building and all units now do not have a clean title. Are there any legal ramifications and what if I wanted to try to sell it in the future?
