Can multiple property owners vote more than once in an HOA in New York?
I own a property in an HOA in New York State. Both our Declaration and Bylaws state that regardless of how many properties a person owns, he or she has just one vote at the HOA annual meeting. At the most recent Annual Meeting, two people voted multiple ballots. Is there a law in NY that states that multiple property owners have multiple votes, or did our board incorrectly allow these people to vote multiple ballots?
Is a crooked fence considered a boundary line after 30 years?
If a fence has been on property dividing two landowners for 30 years plus, is this considered the boundary line when it's clear it isn't straight with the other end of the fence?
Can a member renting a basement apartment serve on the HOA board?
We are a single family home H O A in Forsyth Co. GA. If a member is found to be renting a basement apartment. Can that member be eligible to be on the board of directors?Or restrictions state property can only be used as a ' single family dwelling' and if proxy votes were the only way this member is trying to join the board--- Doesn't the proxy votes be verified by the existing board as their duty. How do we file a lien for a personal loan to my mother?
My wife and I borrowed $60,000 as a personal loan from my mother toward a down payment on our new home a year ago. The loan document gives her the right to secure the principal by lien against our residence. She has asked us to handle the lien process for her, but I'm unable to locate proper forms for filing a consensual lien. Appreciate guidance and/or link to the proper forms.
Is it legal to pay upfront fees to sell my timeshare?
I listed my timeshare with a company in Florida and they were a fraud. I paid thru my credit card and got that money back and now a new company named Luxury Transfer & Financial says they can sell my time share, but the old company (frauds) will file a Estoppel Report and the new people are asking for $2,600 upfront and also they have a buyer who will pay upfront. I don't think this is legal. They also said the Attorney General in Florida got thru to all these bogus timeshare people and got millions of dollars back which they kept while we in other states, etc. paid the price for all the harassment from these types of people. I would love to sell my timeshare, but don't trust anyone.
