What is my liability for my husband's business loan lien on our house?
husband and i own house jointly w right of survivorship/bought house together with my money (paper trail goes back 8 years before our marriage) he has a secured business loan that he took out before we owned this house, and because of his business loss has been unable to pay loan back, there is now a lien against house, what is the extent of my liability, also, would a 'NFTL' lien come before the business lien, even if filed after? thanks
Is the man-made lake an attractive nuisance in this case?
My son was a passenger in a car driven by an unlicenced driver 16 yrs old .The driver was speeding back to a man made lake where there was an underage drinking party.The kid lost control and flipped the car.My son was killed and the 16 yr old ran away with two other teens.There have been complaints filed to the lake owners about these underage part'y's. Is the man made lake an Attractive Nuisance?
Can a bank be required to disclose a lien on property during sale?
A friend of mine filed for bankruptcy last fall. Everything was filed and completed. Early this year she got a call from a friend who said some vacant land she owned was still in her name and all she needed to do was pay up on the loan to bring it up to current status and the land would still be hers. She checked with the bank and they confirmed that she could reclaim the property if she just paid the past due amount and kept the loan current. She paid up, started making payments again and put the property up for sale with a Realtor. The property sold and then she found out the same bank also had a lien on the property for more than she would get in the sale.Is there a requirement for the bank to disclose they have a lien on property they also hold a mortgage on? We were led to believe it was clear and the lien was not identified by the listing Realtor either. I believe we were both misled by the bank and now are out an additional $40,000. Is there a legal way to reclaim this money?
Does filing a motion to dismiss stay a foreclosure sale?
My wife has a home which is in foreclosure and will be sold Aug 16 under the redemption law. Several errors were made in the deed. She wants to file a motion to dismiss . She is running out of time. Does the filing of the motion itself stay the foreclosure until heard by the court?
Can my father add me to his property deed without divorce?
My father lives in Las Vegas, he is still married, bought a home almost 1 year ago, he and my mother have 4 children already adults. On the other hand my mother lives in Vegas in the same house my father own. Only one daughter is living with them. My mother has one property on her own. She purchased it in 2001. each of them signed a grand, bargain and sale deed by the time they purchased their properties saying they don't have any interest on their spouse property. Eventhough they live in the same property, they are separate for more than 10 years. They are old: my father is 77 years old and my mother is 74. They don't see the need to get the divorce or separation agreement. If my father wants me to be on the deed when he died, I just need to prepare the grand, bargain and sale deed and on the declaration of value place the exempt #10 that indicated upon his death it will be on my name, a married woman as her sole and separate property, and a because I am married, make my husband sign a grand, bargain, and sale deed that saying he doesn't have any interest on that property. That will be enough or they need to get the divorce? Thank you for your help I will appreciate so much that you will help me with this matter. Am I right?
