If there is not a living will, 3 children and a home left, what should we do? There is a second mortgage for $18,000. However, the house is worth $150,000 or more and no beneficiary chosen. Mother, who held the mortgage, is deceased. The heirs are three living children, 2 children have same mother and father ( Ages 49 and 43) 1 child has same birth mother (Age 59). Do we go to Probate court or what must do?

My brother is executor of my dad's estate. I received my dad's bank accounts. My step brother is selling the mobile home that sets on rented property. We are to split the proceeds of that sell. I have been paying the rent since May 2008, do I have to continue paying? What do I need to do?

My uncle just passed away and I am named as a beneficiary of his estate along with my brother, sister, and my uncle's sister. My brother & uncle's sister are the executors. What is my right as a beneficiary to find out what's going on in the process of setteling his estate? Do we have the right to know what's going on during the process, or do we just have to wait until the process is completed? Also, does the executor have the right to pay for services from the estate such as having his home cleaned, and do we have any rights where those type of decisions are made?
