Can I petition to be named sub-executor of my wife's father's estate?
My deceased wife was the executrix of her father's estate. A trust fund was created, there is about $2000 remaining and has been inactive for 7 yrs. I wish to access the acct. But I was told that I would have to be appointed as sub- executor. If so. may I petition the court to be named such?
How will my mother's assets be handled if she passes away without a will?
I am the 67 yr. old dau. of my 91 year old mother. My mother has lived with my husband and me for the last 10 years (she is widowed). She and my step-dad had wills drawn up about 15 years ago. After the loss of her husband and a move from IL to TX, the will or wills (?) were lost. I called the lawyer who drew them up but she said she did not have a copy. I know this is FOOLISH, but I cannot bring myself ask my Mom to have another drawn up. All her assets are in both our names. My husband and I both have our own wills. When and if she passes away before I do, how will these assets be handled? Will I be the automatic benefactor?
Can a spouse withhold a will after a person's death?
My sister in laws father has passed away yesterday. Now he was a resident in colorado and had moved to texas to receive treatement for cancer over 2 yrs ago. He came back to colorado 6 months ago to receive treatment and ended up becoming real sick. Will he was bed ridden for 3 weeks he wrote a will. He semi-recovered and moved back to texas. Upon his death his wife had stated that she will hold onto the last will and testament of this man for as long as she wants. I just want to know how does state laws affect such, is that legal? Once i die my spouse can say the hell with it i don't want none of these people (siblings-dependents) to have nothing so im going to hold onto the will for as long as i choose? I've never had no-one that close to me die yet and this situation is screwed up to me. I've been watching this whole family fight over this guys assets (he wasn't rich but worked hard for what he got) the entire time while he was sick and lord have mercy i don't want that occurring with me. Im like super depressed that people can be so damn greedy. But in the interest of my sister n law, i think that its messed up that her father passes and this broad (his second wife) wants to be a hateful person and try and withhold what her husband wanted to happen.

Does the spouse have rights to the property after my partner's death?
I live in tx. I purchased 1 property with a man under both names but different last names. we moved in together on said property. he died leaving no will & now i found out he was married when we purchase property & his spouse is hindering the sale of property by claim of inheritance.I didnt know he was married & dont believe the spouse should have rights to property. does she? If she does, isnt she half responsible for the unpaid lien on the property? it seems that the bank who holds the loan is the hold up. They are assuming the spouse has rights but i believe there are circumstances involved that make their assumption incorrect.
