What are my landlords responsibilities regarding secure entry to my unit?
What are my landlords responsibilities regarding secure entry to my unit? We have been living in a duplex for approximately four years and the entry doors are not secure. The locks were not changed from the previous tenants when we moved in and the front door had been kicked in and was "temporarily" repaired pending replacement of the door. The back door is hung with the hinges on the outside and the type of door is interior, not the kind of exterior door you would expect to be in place to secure the unit. We also have screens for only a few of our windows, most of the frames are bent or broken and missing screens and storms disallowing us from properly cooling and ventalating our home. (We do not have central air.) I would like to know what we can legally do about these issues.
Can I use my security deposit for last month's rent if I have already given my notice?
If I plan to leave my room that I am renting in 30 days, and have given my landlord notice, can I apply my security deposit for the last months rent?
Is there a grace period in Nevada for rent due?
Is there such a thing as a grace period for rent due in Nevada or do the landlords just set this to their liking?
Can I refude to pay rent until the landlord fixes the sewer problem?
I just started renting a home that apparently has a sewer problem. I have resided in the home for 2 months and have repeatedly asked the landlord to have a plumber come out and inspect the sewer smell that radiates through the house and is particularly bad in the bathroom. The smell will take your breath away in the morning. They had a plumber come out and he said they would have to replace the floor in the bathroom. Well nothing has been done. The landlord came by and said the floor was fine, so I asked him to have a plumber come out and see if there was a leak. Well the rent is due again and there is still a smell in my home. It has gotten so bad my children can not sleep in their rooms because of the smell. Can I refuse to pay the rent until this matter is resolved or do I need to call another plumber and deducted it from the rent?
What are my options when terminating my lease early?
I am a tenant in a residential lease in California. I notified my landlord verbally that I would like to terminate my lease 30 days early due to family difficulties requiring me to relocate (I also gave my notice in writing 30 days before I wished to terminate the lease). My lease specifies that I may not sublet without consent and that I may not use the security deposit to pay the last months rent. My understanding is that if I provide a ready, willing and able party (with no legal reason for the landlord to deny leasing to the party) to rent the apartment starting when I move out, that the landlord may not charge me for the last month of rent.
The building manager is refusing to allow me to do this. I would like to mitigate my financial damage as much as possible. The building manager is also refusing to allow me to speak to the owner of the building (who is responsible for making these decisions).
