How can I obtain guardianship for my dad in New York from Florida?
My dad lives in New York and I live in Florida. He is in the hospital and very sick with cancer. He is on life support equipment and unresponsive. However, according to the hospital he has already named me as the person who will make medical decisions for him. How can I get a Power of Attorney or guardianship over him when he can't sign anything and I am in a different state? I am worried that I will have to go through a lot of legal red tape in the state of New York, but I can't spend a lot of time there as I am only going to be there two days.
Does the car need to be returned before the hearing in Arkansas?
This concerns an elderly couple living in Arkansas. The husband died and wife was declared incompetent. Their guardian's signed over the family auto to a niece before the incompetent wife passed away. The wife passed away soon after. A year passed and the sister of the now deceased wife, who lives in nursing home, filed for the car's return. No hearing has been set yet. The will did not mention the car. Does the car need to be returned to Arkansas before the hearing, or does it matter? Could there be any charges for the car upon its' return?
How can we terminate our legal guardianship in Kansas?
My husband and I have been legal guardians to two of our grandchildren for the past five years. One of the children has aggressively threatened my husband and myself with a knife and verbally stating that he will kill us. He was placed in juvenile detention and later a mental facility. Upon his release he went to live with a great aunt and uncle who recently had him removed from their home because they couldn't trust him. His probation officer put him back here stating that as legal guardians we have no choice but to let him live here. We can not do this any more, we can not live in constant fear anymore. What do we need to do to have legal guardianship terminated? (We live in Kansas)
Do I need to live nearby to be my brother's guardian?
I have an elderly brother who is in a nursing home. Do I have to live in the same little town to be his guardian? I am about 4 hours away?
Does guardianship need court approval to be legal?
I downloaded a form to give temporary guardianship of my child to my parents. Must guardianship be appointed by the courts to be legal? Is the form I downloaded a legally binding document?
