Is It Fraud or Negligence for a Seller to Check Unknown on Disclosure Form for Wetlands Property?
Seller checked 'Unknown' to question: 'Is the property located in a Wetlands or FEMA Flood Zone?' After (30) days of moving in the house, I had U.S. Army Corps of Engr. at my property to tell me there was 'consistent soil and plants with Wetland Life...pull the deed on the property.' I pulled the deed alright and it 'clearly' stated 'existing wetlands, proposed drainage easement'. I met with the Seller's Broker and identified what I found and he said, 'You need to discuss that with your Agent.' I stated to him, 'Well, as I see it, it's BOTH Agent's responsibilities to disclose this...and the fact I hired a Real Estate Atty that didn't disclose this either especially when the Atty. SPECIALIZES in Real Estate and Environmental Law?' This matter is only (5) months old....who is negligent? Who bears the responsibility for non-disclosure and INTENTIONALLY checking 'unknown' on the Wetlands question when Real Estate Agents didn't pull the Court Records (Deeds) to answer the question Yes-No on the Wetlands question. The Seller's Broker told me, 'We don't pull the Deeds on every property we sell....' OK, so WHY? His answer was, Because sometimes there's no record on file with the courthouse. I told him...'Well, the property is only (6) yrs. old and the deed was recorded on file back in 2004 when the house was built because the previous homeowner showed me her Deed-Land Survey and it clearly says, 'existing wetlands'. His comment, 'Well...I'm sure our Atty can address that.' Really? How can the Seller's Atty. address that when the Seller NEVER pulled the Deed BEFORE the sale and intentionally checked 'unknown' on Wetlands when the Deed was on file? Does this constitute Real Estate Fraud?
How do I remove fraudulent mortgage filed against my property in Ohio?
I have a $150,000 fraudulent mortgage lien on my property. The scam artist recorded the deed against my property, payable to his now defunct company that doesn't even exist. He is wanted by the law and cannot be found. What papers do I need to file to get these liens removed from my property? The property in located in Garfield Heights, Ohio. I reside in California
Am I Entitled to Punitive Damages For Embezzlement by Payroll Company?
We have a national company that does our payroll.It turns out our account represenative embezzeled a significant amount of money from us. It was withdrawn from our office bank account as payroll then deposited into an account at a different bank that he set up in my name without my knowledge. He then cashed checks off that account. Due to the dwindling office funds I had to take out a couple of loans at a high interest rate to maintain cash flow. I didn't go over the monthly reports from them due to the fact I am not a businessman which is why I used the service in the first place.One of the companies selling points is to take the burden of payroll and taxes off of you and onto us. I trusted them totally. The company wants to settle the matter by giving me a check for the enbezelled amount only. My question is wouldn't they be responsible for damages such as the interest I have had to pay on the loans to keep the office going as well as any possible tax implications as well as punitive damages. This fraud was conducted over a period of a year and a half.
Did the builder defraud me out of money by moving the closing date up then later reducing prices?
I was told by the builder of my new home that we would close on the new house late December 2008. I made plans to visit granddaughter and daughter in Los Angeles for Thanksgiving. Two weeks prior to my trip, they wanted to move closing date to November 28. I reluctantly agreed and changed my plans to come back midnight Thanksgiving. After buying airfare, the builder calls wanting to move closing to day before Thanksgiving. I gave Power of Attorney to my daughter living in Charleston. The following week after closing, the builder reduces price of homes by $20,000. What recourse do I have? If I would have known of this price decrease I would have kept the closing date in December and paid $20,000 less. The builder knew that the price was to be lower the next week and did not disclose this information. Signs were printed with lower price and put up that week. Isn't withholding such information considered fraud?
How Do I Get My Money Back From An Escrow Company
On or about October 21, I deposited money with an escrow company (incorporated in CA) as part of refinancing my house. Due to an action by the escrow company, the refinancing transaction never took place. Since then the escrow company has refused to return part of my escrow money, having since written a bad check for the balance. Moreover they changed their name 2 weeks ago. The escrow agent has since resigned from the company, complaining about my funds being commingled. I am concerned that the escrow company will go bankrupt and name me as a creditor. Their bonding ($50,000) does not cover the balance they owe me. I have already reported this to the DA, but I am more concerned about getting my money back than the company being punished. The amount is my life savings: $280,000. If I don't get the money back I will lose my house and be forced into bankruptcy. I am too old to recover from this calamity. How do I get my money back? The escrow company is located in a different county (Orange County). Do I need an attorney? I can't afford to pay 1/3 to 1/2 of my life savings to an attorney to recover it.
