Is Email With an Attorney a Privileged Client Communication?
I am a Director on the BOD of an HOA. the prior BOD Restated our CC&R's & By Laws and lied to everyone stating they only made legal updates and 1 insurance wording change. They in fact made hundreds of changes outside their authority for our PUD, making material changes to our property rights. I have requested to see the 'Emails and all correspondence between the prior Pres., BOD & Atty' to determine who fueled this usurping of our rights. The balance of the current BOD, the Ex-Pres. neighbors have refused me, stating Atty. Client privilege. What privilege, there is no instant case, they are working records reflecting the job the Atty. provided for US, the client. Question: IS this Client Atty. Privileged materials? Can they conceal those 'working papers and notes from us? The Civil code states as a Director I am able to anything and everything related to the business of the HOA. I believe they are just blocking me unless I hire an Atty. Can I get it??
