Can I take possession of a car I co-signed for?
I had a friend who brought a car and she needed someone to co-sign for her. So I did. The mistake of my life. Sometimes she'll make the payment and other times she doesn't. The loan is thru Wells Fargo and they stated I could go and get the car since my name was on the Title. I have a copy of the title. Is there anything I can do to get this car or get my name off the loan? Also, we aren't on speaking terms at this time. Should I get an attorney and take her to court? I could just confront her and take the car. I would really appreciate some information on how to handle this situation. Or am I just out of luck and I'm going to have to pay on the loan no matter what?
Am I legally responsible if a co-owned car is in an accident?
I co-signed an autombile loan for a friend. The loan is nearly paid off and I am not concerned about obligations to the creditor. My questions is do I bare any legal responsibility if this car is involved in a car accident resutlting in personal injuries or property damage since I am listed as a co owner.
Can Wachovia take money from my account for my son's overdraft?
about 3 or 4 years ago my son had a checking account at southtrust bank now wachovia, well the account was closed due to being overdrawn. my name was on the account. I never wrote any checks or used his checkcard. the only thing I ever did was deposit money into it for him. The only reason my name was on the account was in case something happened to him. Well about two or three weeks ago wachovia took $166.25 from my checking account from their collection dept so they could get the money he owes them. my sons name was not on my checking account. wachovia did not contact me to let me know they was going to do this and they have not sent me a letter letting me know what they did. can they take money from my account like that?
Can Bank of America place a lien on joint accounts for my credit card debt?
I owe credit card debits from Bank of America. Can they put a lein on a joint checking and savings account? The debit is my own but my wife social security check goes into our savings account and my social security check goes into our checking account.
Should I file exceptions for credit card debt if I don't own property?
I received a Motion to Claim Exempt Property on Credit Card Debt. My question is I do not own Property. I am a house wife and my husband is the Owner of our home ( my name is not on the Title) as NC is a homestead state. My question is should I even file exceptions since I do not own property nor have a Job. And most importantly can they go after my husband.
