Am I liable for my husband's credit card debts after his death?
My husband suddenly took ill and passed away last month. He did not have a living will or Trust set up. He did not own any property. He did have a Life Insurance policy for which I am the beneficiary. He had a small savings account under his name and owned a vehicle. He has outstanding balance on some credit cards that need to be paid. He was the primary card holder on these accounts. Am I liable for his credit card balances even though I was not a co-signer? The credit card companies are sending letters to the Estate of my husband(which does not exist) in order to collect the debt. I have about 10 days left in order to respond to them. What is the best way to handle this so I don't have to face them in court or not damage my credit rating ? Is there an attorney who can guide me through the process?
Can creditors pursue a debt from a DBA business formed by a corporate officer?
If a corporation owes a debt which goes uncollected, and an officer of that corp forms another business under a DBA not affiliated with the debtor, but not incorporated, can creditors go after the debt with the DBA?
Can wages be garnished for a repossessed car without permission?
MY SON HAS A REPOSED CAR. IT WAS REPOSED ABOUT 2 YEARS AGO. AND JUST RECENTLY HE HAS GOT INFORMATION STATING THAT IF HE DOES NOT PAY FOR THE CAR, THEY ARE GOING TO GARNISH HIS WAGES. HE WORKS FULL TIME/GOES TO SCHOOL FULL TIME AND IS TRYING TO PAY OFF CREDIT CARDS ON HIS OWN. DOES NOT HAVE A PLACE OF HIS OWN, KIND OF STAYS ALL OVER CAUSE HE CANNOT AFFORD AN APT. AND PAYS FOR SCHOOL ETC. AND PAY OFF HIS BILLS. CAN THEY JUST GARNISH HIS WAGES WITH OUT HIS PERMISSION.
Can my car be taken in a lawsuit for unpaid hospital bills?
I'm currently facing a lawsuit for unpaid hospital bills. I recently received a notice of what is exempt from being claimed. I'm worried that they are going to take my car from me. Can they, and will they do this? The car in question is worth about $6000. To complicate things the car is co-titled to my grandmother who passed away last year, and I haven't had it changed as of yet. Additionally, I recently paid the car off, but I haven't yet had the lien from the bank taken off of the title. So sum things up, the car is co-titled to a person who has passed away and the bank has no interest in the car, I just haven't gotten the lien removed yet. Again, I just want to know if they are going to take my car. If so, how can they justify that when I will not be able to make money to pay such bills without transportation to work?
