I am being garnished for a debt that my ex-husband created prior to our marriage. The company that is garnishing my wages for his medical bills has informed me the bills were started in 1999; we did not get married until 2001. The garnishment was served in his name and my name as his wife. I have been divorced going on 4 years and he is remarried. My ex-husband living in Texas died November 15, 2008. Our divorce was final in California on November 27, 2006. My name was left on a credit card. A death certificate was filed and his name came off but my name was left on. Now, I am being held responsible for approximately 13.0 in his debt. I tried to file fraud charges as I did not make those purchases and did not know my name was still on card. I was not receiving bills as he lived in Texas and I am in California. My credit score is being affected negatively. The credit card company said they are selling the loan and will not work with me. I want to file a lien against his property. He did not have a will and I spoke with his siblings who stated they will not get any money. She intends to sell his property. How do I protect myself and get my credit score back in good standing?
