What legal options do lenders have after a beneficiary change on a loan insurance policy?
A loan for a significant amount of money was made interest free in 1995. The lenders were provided with an insurance policy to secure the loan at the expense of the person making the loan. Eight years later (2003) the beneficiary was changed without the lenders knowledge. The person(s) making the loan have a signed agreement with the deceased that there would be no changes without notice and approval. The insurance company settled the claim with the deceased wife who was named the new beneficiary. She was aware of the obligation of her husband; however, she refuses to honor her deceased husband's agreement. What legal recourse does the person(s) that made the loan have to get their money?
What should I do if my bank continues unauthorized withdrawals?
I have sent a letter to Bank of Hometown to stop taking a draft of $75.00 out of my account. I told them that they no longer had authorization to withdraw from my account but they keep doing it. What can I do?
Can I take legal action against my stepdaughter for unpaid student loan payments?
I am a co-signer on a student loan for my stepdaughter who continuously avoids payment on it. I have paid about $2000.00 on it over a period of 8 years. I am getting harassing phone calls from the lender. She also avoids them as much as possible, but the last 2 times she set up payment she had insufficient funds and then they proceed to me. Can I take out a debt warrant or is there something else I can do to get her attention. She is married and both her and her husband work and have 2 kids. They also are bingo addicts and I know they do not want to sacrifice that and her husbands obsession for fishing and buying expensive fishing equipment.
Can I sue my ex for a loan jeopardizing our home?
I own a home in Santa Cruz with a $640,000 mortgage; which I've paid on time all along. The home is held at this point with my ex who 18 months ago borrowed $75,000 as a short term hard cash loan that is due in August of this year. My ex has really gone off the deep end and now feels unable to pay. I am having no luck finding refinancing for this $75,000 . Can I sue my ex for taking out a loan he can't repay and jeopardizing the home in the process? What about the hard cash lender; can they actually take my house from me over $67,000 in spite of the fact that I am in good standing with my primary lender with a $640,000 balance?
Is my son protected from lawsuits as an innocent spouse?
My son's wife was convicted in Federal Court for embezzlement. The judge referred to him as the innocent spouse at sentencing. Is he protected from lawsuits from the people she stole from?
