What is a a Walker Hearing?
I'm involved in a Superior Court case where the judge ordered a continuance of a case management conference hearing and then said he'd be conducting a Walker hearing and he wanted briefs five (5) days before the resumption of the next case management conference. First, what's a Walker Hearing? I know it has to do with monetary amounts involving a threshold of $25,000.00. Does my brief have to prove that the case is worth more than $25,000.00 and is it done in a pleading format or not?

Why would I receive papers for a civil lawsuit that are not signed or filed by the court?
I am the defendant in a civil action brought by my boyfriend for whom I ran his excavating business for ten years. I had power of attorney and was the sole beneficiary of his will. In June 2003, when I refused to marry him, he accused me of many things and was going to prosecute. The prosecutor said he had 30 days to file the charges or they could never be filed again. He dropped it all and now four years later has filed a civil action citing criminal statutes: forgery, theft and fraud. I am a cancer survivor with COPD - hospitalized several times in the last three years for congestive heart failure. I collect $408 per month SSI, only working one day a week for $80. The only asset I have is a 1999 Ford that was a gift from a family member last June. Therefore, I cannot afford an attorney. In fact I answered the Complaint myself, denying almost all of the 14 Counts totalling 103 questions. I have a few questions: Can he still or additionally file criminal charges and am I in jeopardy of being incarcerated? If I do not answer the interrogatories, admissions and production of documents will it be a default judgment? Interestingly, these papers were neither signed nor filed with the court and were not sent certified. Are they valid?
What is an acceptable amount of time to receive information from your attorney?
We are currently working with a lawyer who doesn't really seem to be all that knowledgable in child support cases. He had assured us that he was. We paid $750 up front and provided all financial documentation. He stated that he charges $75/hr. We went to court once but the plaintiff didn't show up. He said that he "needed to put time on the books so we talked for an hour and he drafted a letter. We have had 2 more court cases which he was not notified of by the court, so they were rescheduled. He is now asking for more money. We have asked for a detailed accountability report to be faxed to us. We have not received it. He keeps telling us the file is at home he'll fax it later. Now we're getting he's been busy and will get to it in the next few days. We have now requested the report 6 times. I have been keeping conversation records. What is an acceptable amount of time to get the information? What recourse do we have?
