Is a forged contract automatically null and void?
Is an unauthorized altered contract automatically null and void? A contract was entered and the other party changed the content of the contract and forged my initials before recording it at the court house. I need to know if this contract is now null and void automatically?
Can a seller cancel a purchase agreement for a better offer?
Can a seller go back and cancel a purchase agreement if the seller gets a better offer than the one on contingency from buyer?
Does my ex-fiance have a legal case for the down payment and equity?
My fiance and I purchased a home together. We each put money down as a down payment. My name alone is on the title, however we both signed for the loan. My fiance has since moved out. He is taking legal action against me for the return of the down payment. A rental agreement was signed by him and he is also asking for the equity money back. His attorney is saying I either pay up or they will take me to court. Does he have a legal case against me? My ex-fiance also signed a promissory note which was notarized and payable to me next month. His attorney says the note was signed without consideration and is therefore not enforceable in the state of Nebraska. We also signed a separation agreement and again his attorney says that is not recognized or enforceable in the state of Nebraska. Do I need to roll over and return his deposit or do I have a favorable argument?
What are the implications of leaving a competitive sports team early?
We signed a contract for a competitive sports team for my 11 year old. The financial agreement was for $80 per month for 12 months. After two weeks of practice we realized that this is not the team for us. Several things were promised but not delivered (ie all star experienced only team, gymnastics coach). In addition, the overall skill level, organization and potential for advancement is less than we expected. We have decided to pull our child off of the team - ready to deal with the financial implications. Unfortunately, we now see the following statement in the contract: 'I agree that the cheerleader may be dismissed from the team with little or no warning due to violations in the handbook and agree that they will not participate on another team for 90 days from dismal or discontinuation'. The handbook does not address leaving the team (just missing practices, failure to make payments, etc) Does this statement cover us leaving or only if they dismiss us? If we chose to still sign our child up for another team before the 90 days that the team decides upon legal action, what is the worst that could happen?
How long does a store wait for consignment payment before reselling an item?
I purchased a china cabinet from an antique store, but before it was delivered (or my check cashed) the store managers discovered that the owner of the cabinet had already sold it to someone else. That person had also paid for the cabinet. However, the owner refuses to pay the store for their consignment, so the store refuses to release the item. How long does the store have to wait to be paid their commission before they can consider the owners transaction void and resell the cabinet to me?
