Can a subcontractor persue payment from a customer if the contractor never paid?
If a subcontractor is not paid by the contractor, can the subcontractor pursue payment from the customer (ie: the entity who hired the contractor and for whom the subcontractor performed the work)?
The work was performed in both Colorado (at the customer site) and in Florida (where I reside and work from home).
This is not the construction industry, it is computer software.
How many days do our subcontractors have before they are required to file intent to lien?
We are a General Contractor. I would like to know and be able to have a copy of the Lien Laws that govern our Subcontractors and their Vendors. Specifically how many days they have before they are required to file the Intent to Lien?
What recourse do we have for a contractor charging us more after we have paid what we owed to him?
We started an addition on our house in May 2008, It was supposed to be completed in 3 months time. Our contractor just finished first week of December. He came to collect the final payment, we withheld $500.00 because we did not have the CO. We told him when we get the CO we would gladly give him the money. He finally got our CO and we were going to give him the 500.00 and he refused it saying that we owed him an additional 6500.00 for a cash discount he gave us for paying in cash. Also he now is claiming that he did 3500.00 in work that he did not charge us for and now wants that money too. He has threatened to put a lien on our house for this. We have paid all of our installments and have receipts to that effect. Any adders have also been paid and have the receipts to that effect. What recourse do we have?
Can a subcontractor file a lien against my property for not being paid by the contractor?
I live in Georgia and hired a Pool contractor to build an in-ground pool. He, in turn, hired several sub-contractors. I have paid the contractor the full contract price plus cost for some change orders. The work was completed around June 30, 2008. I recently received a notice that the plaster company was filing a lien against my property for failure to be paid by the pool contractor. On 10/25/08 the plaster company came out to take some pictures and I asked them to take a look at a rust spot where the re-bar was rusting through. They repaired the spot and have the project finish date as 10/25/08. What constitutes the 90 day period from completion of the project? My understanding is contractors must submit lien notices within 90 days of project completion. The pool contractor is filing bankruptcy.
