Can a member represent the LLC in civil court or must it hire an attorney?
I am the majority shareholder (83%) in Quantum Labs LLC. Quantum Labs LLC is being sued by FedEx Freight for late payment in Civil Court for $10,830. I personally filed a response to the suit claiming 'Unjust Enrichment' since the last statement from FedEx Freight we received was only for $4,400. Now the Plaintiff is requesting a Default Judgment on the basis that I personally responded, and not an attorney, since Quantum Labs LLC is being sued. My question is: Shouldn't I personally have the right to respond since I am the majority shareholder, and the $'s in question is less than $5000 (this suit should be in small claims court, not civil court, where there are no attorneys allowed - right?)? Can't I defend myself? Or do I need an attorney to respond?If I can defend myself, please recommend the proper forms that I should purchase. Thanks,A.J. Robertson
How can we get a hearing delayed until new legal counsel is secured?
My son's attorney just withdrew from his case because he said we have no confidence in him. He's right. This is a custody situation and the other side has called a court hearing. The problem is the attorney who my son wants to hire ( she has verbally agreed to take the case) is out of town for another 3 weeks or so. The hearing will take place before she returns. We really want her services. Can we have the hearing delayed until she returns? What do we need to do?Thank you,M

ithe doctor gave me some medicine that swollen my fingers up ,they are leaking fluid,very sore.i went to the doctor twice still no help ,may the 9th will be two month i been going through this ,do i have a case?
How Do I Get the Gas Company to Repair the Damage They Caused on My Property?
Last year I purchased a house. I came home one day in November and the gas company, Vectren, had jack-hammered a big hole in my concrete driveway and torn up my lawn to replace risers in the neighborhood. I was not notified of this and they just filled the hole in with gravel and left after they were done. I called three times and was given told that the hole will get fixed by a concrete contractor and someone would call me. Nobody ever called and every time I call the gas company I get the same line. The damage reduces the value of my property and the gravel is starting to come out of the hole. What are my options? Can I take the gas company to court? Would it be small claims court? I have email documentation as well as photos. Thank you.
Can I Have a Support Order Voided if I Didn't Understand What I Agreed to?
In 2005 I signed a divorce agreement in which I agreed to pay my ex wife (of 9 months) $13,500. At the time I, I had been receiving treatment for a broken neck and intra-cranial injury. My physical injuries as well as the resulting cognitive injuries are well documented by a host of treatments including electro convulsive therapy. I am currently and at the time of the divorce 100% disabled and my only income is social security. I signed the agreement in an effort to 'put the issue behind me'. Recently my ex-wife is attempting to serve me with papers in Arizona where the divorce took place. I currently live in Michigan where my sister is helping me with my life. I need to know what if anything the judge might do if I don't appear. I believe I signed the agreement without fully understanding what I was agreeing to. I am also wondering if I did not have the contractual capacity to sign, if there is anything I can do to have the agreement voided. I simply do not have the money to pay the judgement. It is now 2011 and I thought this issue was behind me. I am also a Vet and wonder if there might be legal help for me. Thank you.
