What Can the City Do to My Dog for Biting Another Dog on My Property?
My dog bit another dog on my property. Two days later, the animal warder came and took my dog out of house to the shelter until a court date cold be set. The animal warden did not have any legal papers when she took my dog by force out of my front door. My wife answered the door and the warden put her safety stick on my dog and pulled him out of my house. I was at work but talked to her on phone. I asked her if she had a warrant and she said no. I ask her to wait until I got home from work and she replied no, she was taking my dog now. She did not leave her business card or any legal papers. When I got home, I called the sheriff's office and told them what happened. The sheriff contacted the animal warden and she said she would send the papers when she finished them. I am a truck driver and I told her I would be out of town the next day and I wanted the papers that night. I was very upset at this whole situation because I am sure that no one can take anyone's personal property without proper legal papers. 3 hours later, a sheriff came and delivered the papers. Now my dog is in the shelter for 2 weeks. I go to see him on Saturdays when I am home. I go to court this Friday for a ruling from the judge if he is a vicious dog. I am very upset by this situation. I think it is wrong because the other dog came onto my property. My dog has never bitten anyone or anything before. He really loves people and babies and I do not think he would bite anyone. That has been proven many times before. He loves kids and loves to play. He is not vicious. Anyone who knows him would tell that. The only witness were two small kids and me. I have a trampoline in my yard and kids are always playing on it without permission, I opened the door to tell them to go home before they get hurt and I get a lawsuit and my dog ran out into my front yard. I did not see their dog when he ran outside. The dogs sniffed each other and I think the little dog snapped at my dog and he bit it. The little dog was taken to the vet and will be OK but needed some fixing. My dog weights around 110 pounds and the little dog maybe 10 lbs. I think the little dog followed the kids on my property and if they had been supervised, this would not have happened. I live in a rural area with few house and these kids live about 1000 ft from my house through the woods. I cannot even see their house from my yard. If the kids had not have been on my property, this would not have happened. I am sorry about their dog. I was in my PJ's when this happened and when I got dressed, the kids and the dog were gone. I did not hear anything for two days until the warden came at around 7 PM. I tried to get home from work but she had taken my dog already. According to the warrant, there is not vicious dog if it happened on my property. I was told the judge could even kill my dog if he ruled vicious. This is the first time this has happened. My dog is neutered and is 5 years old now. I have had him since he was a puppy and he has never bitten anything before. This is the truth I have told you. I think the fault was with the woman who was not supervising her kids properly. The two kids, a boy and a girl, are about 5 and 6 years old and are the only witness besides me. I live on a private road that is not maintained by the state live in Orange County, VA. I really cannot afford a lawyer but i feel this is very unfair to take my dog. I would appreciate any advice.
