Can My Landlord Deny a Service Animal if I am Bipolar?
I am a resident and co-owner of an apartment in a senior community in Seal Beach, CA. They allow only small dogs, or 'service dogs'. I signed a pet agreement six months ago when I moved in to care for my Mom.Recently, I asked for an exception to be made. I did not tell them directly that I have bipolar, but I submitted a letter from my doctor and signed a medical release. The letter suggested that it might help my mood, motivation, and ability to care for my mother to have the dog. I felt that the letter could have been stronger, but I actually don't think the HOA cared about the content of the letter. My psychiatrist said that I could not consider my dog a service dog because there wasn't a task she was trained to help me with, nor was there a specific task that I needed that was beyond what a companion animal could provide. The HOA informed me in writing that my request was denied because I signed a pet agreement upon moving in. They gave me a copy of the agreement that I signed along with their letter of refusal.Losing the dog would be overwhelming to me. I am responsible for the care of my mother and I work fulltime. I have three children in college that need varying degrees of ongoing support. I am divorced and for the most part alone. I am needed by others, and I need to take care of myself.I wonder if my HOA has offered a resonable accommodation by allowing small dogs? I think I can get a stronger letter from a doctor. I am willing to work with a dog trainer if there is such a thing as a psychiatric service dog.Thank you
Am I Liable for Hitting a Dog that Ran Out in the Street in North Dakota?
I recently hit a dog on a paved county road. I was turning a corner not going very fast as I drive a big SUV anyway the dog came running out at me and before I knew it the dog was under my vehicle. The dog owner is saying I have to pay for the dog bills. There may be damage to my SUV as well. The dog was not tied up and was very aggressive as it was charging at me. Am I liable for this dog or is the owner of the dog responsible for not controlling his dog?
Can a Landlord Restrict the Number and Size of Dogs?
Is it legal in the state of Arizona for a apartment manager to make tenants re-register their dog(s) to enforce the dog restrictions? According to the lease any dog owner who signs lives in the complex must register their dog(s) at the time they sign their lease to include the pet's name, weight, type of dog and license number for the state of Arizona. There is also a restriction on the breed, weight and number of dogs allowed which is 2. I have noticed that there are more dogs here and some of them are over the legal limit, which is 100 lbs.
Can I Recover Vet Bills for an As Is Sale of a Puppy That Died of Congenital Problems?
I bought a puppy approx 3 weeks ago who had a congenital liver defect that caused her to have severe seizures, brain damage & had to be euthanized. The breeder states that she will refund my money when I give her all the documentation. Unfortunately I signed a bill of sale that said 'as is'. When I asked the seller re this he stated that he always wrote that as he sold used cars in the past. Now the breeder is willing to refund the purchase price if I give her all the documentation from the 3 vets that cared for my puppy. I sustained approx $1700 in vet bills. Do I have a leg to stand on to sue these people for my vet bills?
