Can a Small Estates Affidavit help reissue a stock certificate for a deceased parent?
Can I use a Small Estates Affadavit to meet the Stock Certificate Transfer Agent's law requirement for them to reissue a stock certificate in my deceased father's name? The stock value is approx. $990, and there are no other assets of my father that must be declared for probate? And if so, can that reissued stock then be deposited into my joint stock broker's account(my deceased father and I are registered as co-owners of the account). The Transfer Agent says since there is a Certificate Loss, if the Small Estate Affadavit won't qualify, I'll need to get a Certified Letter of Appointment, which I think will be expensive, approaching the value of the stock.

Is simple probate possible if there is a home involved?
My mother passed on 1/5/2010. She left a will naming my youngest sister as executor and beneficiary of a small life insurance policy _$5,000.The only other assets she had was a checking account @_$2,000, and her personal belongings with a value of _$500-1000 (?) Her home in Nampa Idaho has a mortgage owing of _$90,000 and her only other debt was a credit card with an outstanding balance of _$3000 Initially we understood my sister could file a 'simple' probate, but arepresentative with Ada County 'probate help desk' advised us that since there is a home involved that is not possible. Is that the case? Would an 'unsupervised or independent' probate be appropriate/necessary?

I live in tx. I purchased 1 property with a man under both names but different last names. we moved in together on said property. he died leaving no will & now i found out he was married when we purchase property & his spouse is hindering the sale of property by claim of inheritance.I didnt know he was married & dont believe the spouse should have rights to property. does she? If she does, isnt she half responsible for the unpaid lien on the property? it seems that the bank who holds the loan is the hold up. They are assuming the spouse has rights but i believe there are circumstances involved that make their assumption incorrect.
