How can I find my father's Will and contest my mother's Will?
My father past away 4 years ago. I am 1 of 4 children. I live in NC and need to know how to find his Will. Also my mother passed way 12/31/06. The only thing I have received from my brother is a Last Will and Testament that is not signed by a Notary and my sister is listed as one of the wittness. Is this document legal? How do I contest the Will? I do not believe my mother signed the document. She passed on 12/31/06 the document was dated 12/20/06. How do I find her Will prior to this one my mother was very ill on the date the will was signed I do not believe she was of sound mind and could not have signed the document. How do I go about proving she was not of sound mind on the date the document was signed.
What should I do if my son died without a will in Michigan?
My son passed away on Oct. 28, 2006 and he did not have a will. His mortgage company will tell me nothing and I can’t close his bank account or cash a $269.00 dollar check sent to his estate without legal papers or a power of attorney. What do I need to do. He has no children or wife. I am his mother.
Does my mother-in-law's will automatically pass her estate to me?
My mother in-law has a will that names her son to get a equal amount of her Estate when she dies. Her son (my husband) passed away 10 years ago. She said her estate will go to me, and she does not have to change her will to substitute or add my name. Is that true?
Does an adopted child inherit from their biological father without a will?
Mother and father divorce. Mother remarries. Stepfather adopts child. Does the child have an interest or legal right to be beneficiary of her original father's assets if he dies without a will or do the assets go to the state? There are no other possible beneficiaries.
Is Florida law similar to Mississippi regarding joint accounts and claims?
My Father and his wife lived in Florida. Father's wife had a joint checking account with her elderly mother in Mississippi. This account had approximately $200,000.00. The Mother passed away. Three grandchildren (nieces of my father's wife) filed suit claiming their share of the $200,000.00. There is on file a letter from the attorney for my Father's wife's in Mississippi stating that a Mississippi statute protects the money from any claims by the grandchildren or nieces, because it was jointly held. Fast forward, my father died unexpectedly at their home in Florida. Last fall he had my brother and I put on all of their checking accounts jointly. My father's wife's will (she is not deceased but is dealing with Alzheimer) leaves her estate to her husband (now deceased) and her nieces. My question--- Is their a statute in the state of Florida similar to the one in Mississippi that leaves that money that is jointly held by my father's wife, my brother and myself to the 3 of us? i.e. is it protected from any claims by the grandchildren/nieces?
