i was served papers about a credit card lease that was falsely presented to me in 2007, the paper says they will go to court in Cook county, by reading blogs this is what they say 'They have to sue you in the county in which you live in--but they don't always follow the rules. So when you get served, you will need to submit a 'Motion to Change Venue' to the IL court they filed the action in. You will allege in that motion that the IL court has no personal jurisdiction over you because you live in FL . If you do not file this motion once you are served, then you will waive the jurisdiction and the IL court will have authority over you. My question is how do I do this and can i send a form?and i need to do ASAP as I was served 2/18/10,and the supposedly PAPER says the return date is March 11th.. I am sure they are just trying to scare me but this is probably going to happen 'court wise' cause they actually served me.

My divorce was final July of 2008 and was heard in Roanoke, VA. I want to change the venue to Bedford City and have spousal support reduced from the 36% of my income I am paying now, to 30% as my income has decreased 40% in 2009. I also want to subpoena her mortgage and health ins. payment amounts, as that is what the judge used to determine support. I also want to see her tax returns. She claims to be disabled due to depression, so I want an independent physician to evaluate her to see whether she is disabled or not. If she is I want her to apply for disability payments. I am still paying the legal fees for my ex-wifes lawyer as well as my own, so i don't want to hire another lawyer and have more legal expenses.

I need to transfer to a local court. I need to file a notice of motion to transfer courts to a local one. What form number do I need?

If a person lives in Texas, has a job there, gets mail there, and sees doctors there, are they a resident there even though they did not change their drivers license and are also using a P.O. box in another state where they grew up?
