Can I Trim My Neighbor's Tree?
My nieghbor is treating me, calling the police and other horible actions all because I want to trim back his tree limbs and branches back to my property line. He is saying that I cant cut a branch if it is over 2 inches thick??? The trees are blocking light to my 17 arborvities that are under these trees, stunting the growth, they also cause alot of litter every year that i have to clean up. Do they have the right to tell me what trees i can trim? Can I get into trouble for trimming there tree back only to my property line, If the tree is not adversely affected?
How Do My Neighbor and I reach a Resolution on Trimming the Trees on Both Properties?
my neighbor's 'heritage' tree (as defined by city code) has roots that have significantly damaged and uplifted my driveway. The city requires a permit and inspection from the city's arborist to decide on whether roots can be cut/trimmed (after I remove the existing concrete)and prefers that the tree's owner gives permission. The owner has not given permission, nor is cooperative in paying for any of the replacement driveway. Also, the tree's limbs need to be cut back from my roof, but the owner will not cooperate in allowing tree trimmers to climb the tree. With several emails between he and I, in which he asks for more details and legal references, as well as, he suggesting that we shouldn't need to go to litigation, there still isn't any 'negotiating' taking place (it's been over 90 days).Do I have any rights here in Sacramento to be compensated for the damages to the driveway and my roof? The tree is a deador cedar that during the whole year drops needles and other major debris that clogs my tile roof and discolors my porch awning.
Can My Neighbor Force Me to Trim Branches Overhanging His Property?
I asked my neighbor in 2001 if I could plant a hedge between our property. He said it was okay. Since that time, almost 9 years, he has trimmed the hedge that has passed through the fence onto his property without complaint. Recently, we had a falling out about his children's access to my property and the destruction of some of the plants in front of my house. He became very irate. I denied his children access to my property. Now he wants me to trim the hedge that grows through the fence. I have talked to the head of the HOA about this and initially recieved a positive response but now they are avoiding the issue. I have just received a letter giving me 14 days to trim the hedge (or else, I don't know what). I no longer feel safe entering his property and honestly, I think we would both be best served if we don't have to interact anymore. I also don't want to give him any grounds for reciprocity. What does the law say about trimming the hedge and what is the best way to handle this problem.
Can I Trim Branches of Neighbors Tree Encroaching on My Property?
My neighbor has a tree that is hitting the roof of my house. I told him about this problem and told him I would pay for 1/2 the cost to have this part of the tree cut and any branches that will grow in the future cut. He agreed and said he would get someone to do this. Now he's changed his mind and he doesn't want to do this. Can I have the part of the tree that is hitting my house and that is way over the property line cut without getting his permission or getting into any trouble?
How do my neighbor and I reach a resolution on trimming the trees on both properties?
I am being sued by my neighbor in a small claims court for $3,000.00 spent throughout four years for trimming the branches that grow into her area from my trees. Is there a document or code that I can show to clarify that such branches are the responsibility of the adjoining land owner and not necessarily the responsibility of the landowner where the tree is rooted? I wish I could find a written code or regulation stating this tradition of the right to let neighbors get rid of branches that grow into their property, but not charging the owner?
