Can a Private Club Charge Higher Dues for Owning Multiple Properties?
Can membership in private clubs be based on the total number of lots in a community or is it limited to the people. I am one person but because I own two lots I must pay two membership dues to this private club. Other people who only own one lot can have as two legal members and an unlimited number of guests using the facilities of this private club but only have to pay one membership.
Can We Create a Private Road Maintenance Agreement Signed By a Majority of Owners?
Does evereyone have to sign a private road maintenance agreement to make it effective or can a majority of the owners officially implement? Also does it need to be witnessed, notarized and recorded in the Maricopa County Land Records?
Can a Remainderman Sell Their Share Without the Consent of the Life Tenant?
My father put my sister and me on a general warranty deed with reservation of life estate in October 2001. However, we have 4 other brothers and sisters that we were told to share this property with. Why he only put two names on the deed is beyond me! He is still living (age 88 and still going about his business). Is it possible for my sister and me to add our other brothers and sisters to this thing? Or are we going to be faced with big problems someday trying to share this with out siblings? We are talking about 320 acres of farmland, with three homes each at least 100 years old.
Is a Homeowners Association Liable for Mold Due to Failure to Repair Roof?
the DOC's state the HOA is responsible for 'roof maintenance, repair ...' . I have mold growing on my ceiling as a result of a leaking skylight. Since the HOPA failed to even communicate with me I had to get the DBPR in Tallahassee involved just to get the leak fixed. Are they also responsible for fixing the damage to my drywall as a result of 'failure to maintain' (the roof is at the end of its lifespan) ? I am aware that FL does have a different approach to damage to other peoples property.
Can I Prevent a Neighbor from Disputing a Land Survey?
My neighbor continues to encroach upon my property even after a survey was completed, for which she paid. I live in a new construction neighborhood. All homes were built within one year of each other. My house and the houses on either side have been through several surveys for various reasons (purchase, pools, fences, and finally foreclosure). There has never been any conflict regarding the properly line between my house and the house next door. Ten months ago the house next door was purchased out of foreclosure. The new owner almost immediately began encroaching on my property with shrubbery and landscape border. I have talked to her several times and she continued to claim she was told her property line was where she thought it was. I asked her to refer to her survey but she refused. Two months ago she had a fence installed. The fence company had yet another survey performed. The survey line between our homes aligned with all of the survey information I have for my home, and previous surveys I had seen done on that property for the pool and foreclosure sale. However, recently she has begun to encroach upon my land again in areas where the fence was not constructed. She is planting shrubs and placing landscape borders over the property line onto my land. In some places it is only several inches, in other it is over a foot. We have talked and she is now making the claim that I moved the survey markers and it is her land. The marker nailed into the sidewalk is still in place and she is clearly beyond that point. This is malicious and is in addition to other nuisance behavior she has performed towards me and my home. I have not moved the survey line as when it was done I was very pleased in hopes it would put an end to her prior behavior. Now that she has had a survey performed and is fraudulently claiming it has been altered by me, what legal recourse to I have to first get the encroachments removed and second be able to have enforced should she continue the behavior after any finding in my favor?
