Do squatters have rights against rezoning and development in Florida?
I have lived in a wooded area of orange county for 30 years now and the owner wants to rezone the land and develop it. As a squatter have I any right to stay here in my home and stop the rezoning process and development of this land?
What steps are needed to properly deed additional property from my mother?
My husband and I are receiving property from my mother. My sister and her husband are receiving property also. My mother is dividing 10 acres into three lots. We currently live on part of this property and have it mortgaged. She is deeding additional property to us. The way the family division was done and approved is for the 10 acres to be divided into three lots. We will be receiving Lot 3. However, we own part of the lot already. We are receiving property on either side of what we currently own. I do not know what steps need to take place in order to properly deed this over. Can I just add the new description for our lot with a warranty deed and record it with the additional property added?
Are there setback rules for docking boats near property lines?
I live on a lagoon. I have docked my boat in the same spot in front of my property for 30 years. The stern of my boat is 6 feet off the property line to allow for tide swings and wind. My new neighbor has tied his boat up with the anchor overhanging my property. As a result I can no longer dock my boat as before if I want to avoid damage from his anchor. I will have to move permanent docking fixture as well. Is there a set-back rule for boat docking?
How can I respond to a mortgage default notice in Oklahoma?
I need a response letter for a notice of default on a mortgage in Oklahoma. We have had an audit done and are in the process of trying to get our mortgage modified. The audit showed many law violations during the purchasing process. I need to respond ina way that stops the court proceedings. Do I need a 'Notification of Discovery Servie' letter for Oklahoma as well?
Can I offer a deed in lieu to my mortgage company?
In August 2008 I had to move from my house. I had not made payments since Dec 2007 and my wife had just died a year prior with a 60% loss of income, I could not keep up with escalating mortgage payments. The house was supposed to be sold by courts the last week of August 2008. That sale has still not taken place and I am still on the hook for the home owners dues, taxes, and assessments. Can I offer up a 'deed on lieu' get it registered at the court house, and thereby pass title to the mortgage co? I am 67 yrs old and raising a 13 year old granddaughter and feel the need to move on with my life. Right now the house is in limbo, they took it off the sale block and it is just sitting empty. I had it up for sale for 18 months and within a week after I moved out, they kicked my realtor out and changed the locks. They offered it back to me under this new program about a year ago, but I do not want it back, just want it out of my life. Are they in any way obligated to accept a deed in lieu?
