Do I need to secure a release of liability for demolition?
I am the manager of an apartment building. The owner has asked me to secure a release of liability from the owner of the neighboring apartment building who has refused to participate in the the demolition of the fence and plant matter that has grown between the vertical slats and horizontal stringers of the fence so the fence has become so distorted that no posts or slats are 90 degrees any more. The owner of my building is going to proceed with demolition and construction of a new fence, but it means destroying the hedge of vines and plants from the neighbor's property. The owner of my building wants to protect himself from any liability. What should we do?
Is a loan guarantor protected if lender obtains property through non-judicial foreclosure?
If a lender/bank makes a non-judicial foreclosure on my real property, and at the sale gets no bidders and buys in the property itself for the balance on the loan, can it then also sue me personally on a personal guaranty I signed when I made the loan? Who is Responsible for Maintenance of an Easement?
I am the owner of a small hobby farm in Washington Co Kentucky.To access my farm I have to drive across a deeded right of way which is mentioned in my deed and in the deed of the owner of the farm I travel across.For the last 24 years I have been the only one maintaining this road which is gravel.The maintenance consist of cutting the grass on the edge of the right of way.The road is 10 ft. wide and a half mile long, the easement is 20 ft. wide. Ordering the gravel and spreading it with my tractor. Filling pot holes 3 times a year. Digging and maintaining drainage ditches. Purchasing and installing culverts. Installing and cleaning out cattle guards. Pruning and trimming tree branches in the right of way and plowing snow and ice.The farm now has a new owner and I am told to stay off the road with my equipment and that he will maintain the road from now on. So far he is doing a fair job but the tree branches are scratching our cars and this winter he would not let me plow the snow so my wife had to stay in a motel and I had to put chains on my truck tires. His argument is that the plow damages the gravel surface which is partially true but since I have been maintaining it all these years I would just fix it in the Spring which I considered a traded off since chains are a real nuisance to put on in freezing weather for just a half mile and they won't work on my wife's car anyway. What are my options?
Can I Terminate an Easement if I Buy Adjoining land?
I own a 6 acre lot in PA, that is the second to last lot on a mountain dirt road. There was one more 7 acre lot beyond mine which was supposed to be a common area on which the road terminated as a cul-de-sac. When the developer tried to transfer the property to the owners association, they refused to accept possession of it because they didn't want to be burdened with the property taxes. As a result, the developer put the lot on the market and sold it as another private lot. I purchased the lot and had both lots combined into one deed. Would any easement across my first property be extinguished now that I own both properties (Unity of Seine), and do I have the right to gate off access to my property, providing I construct a new turn around area for motor vehicles?
