What type of deed is needed to give my mother in law an iterest in our home for tax purposes?
My wife and I built a home in Garden Ridge (Comal County), Texas and took out one mortgage (converting the construction loan to a permanent loan) after completion in June. We will be filing for a homestead exemption on our property taxes. But our question deals with my mother-in-law, who moved in two months ago (we built the house with her in mind). She took the over-65 and disability exemptions on her old home. What type of deed do we file to give her an interest in the home so that we can file these additional exemptions? Is it a Special Warranty Deed for a 50% interest (whereby her exemptions would be half of normal)? Or is it legal to do a deed conveying her a 100% life estate only, retaining the fee simple title in our name?
Can you put a home in trust that still has a mortgage?
I had a paralegal set up a revocable trust for me and my spouse. She told me that the leinholder on my home would not let me put the home in the trust because I owed them money. I only owe one seventh of the value of the home. Is this correct?
What recourse do I have if I was sold a business with false papers?
I was sold an ice cream/sandwich shop with false papers. What recourse do I have against the seller?
How do I obtain title to property that I have used next to my land for years?
I use a parcel of land on my property that does not show up on my deed. I have used it for 6 years. What is the term that goes with obtaining title to it? Since my property deed is listed 29 acres more/less, and the neighboring property is being sold 12 acres more/less, there might be a dispute.
How do we have my mother's transfer of property set aside if there was deception involved?
In 1989 my father died. Dad and Mom had their home paid for. Mom gets lonely and marries a deceptive man and he gets his name on the deed as a joint tenant with rights of survivorship. Mom became ill in 1995 with Scleroderma and needed dialysis from June of 1995 until she died in October of 1997. He is thinking of a reverse mortgage. What is this? Is there a way to set aside my Mom's transfer of the property to him?
