How can I write a buyout agreement for a timeshare during divorce?
I am going through a divorce and we have not gone through equitable distribution process yet. I would like my husband to buy me out of a time share we bought while married and have agreed on an amount. How can we write this transaction up on our own and have it hold up in court.
How can a couple equitably divide income from shared assets during divorce?
What if the husband and wife both want to divorce but do not want to split up assets that were acquired during marriage. The assets involved are land with significant oil and gas revenue. Both parties are not interested in dividing up the land because of the estate plan for their children. But they are interested in seeing an equitable solution for existing income division if possible.
Can I recover equity from my first home in my divorce?
Prior to my current (2nd)marriage I was married and living in Florida. My 1st husband purchased a home - his name only was on the deed but mine was also on the mortgage. My 1st husband and I divorced. I re-married and my second husband and I lived in the home for one year. My 2nd husband drew unemployment during this time. My first husband quit-claimed the home over to my 2nd husband and myself. We obtained a new mortgage in both our names. We also took out a loan in both our names for repairs on the home. We sold the home, making a 60,000. profit. We paid off the home-improvement loan. I don't know what my 2nd husband did with the remainder of the money. Two years later, we did pay off a $26,000.00 loan we had made for a down payment on our current home. I am now divorcing my 2nd husband. Is there any way for me to get that equity money from the first home back, or get this second home since the $26,000 probably came from the sale of the 1st home (I cannot prove that)? If so, what Arkansas law says that I can.
How can I protect my equity in a home after divorce?
My ex-husband is living in the community home and wants to refinance it in order to pay miscellaneous bills. Ultimately he wants to take my name off the loan; although, he still owes me $50K in equity. However, he cannot afford to pay me $50K until the appraised value goes back up. How should I request or have Deeds worded to protect my equity if something should happen or disable him to repay this loan? Could I file a lien for my $50K or have a special document attached and filed when the house gain it's value, I get my money? His position is that the bank may not let me be on the deed considering I am not on the loan. To your knowledge is this true? I bought this home when I was single before we got married and did not force a sale when we divorced due to downturn of value. What I need is security to protect my equity for me and my estate if I should die as well. How can I protect myself and my investment? The home deed I am referencing is in San Diego CA; I now live in Colorado. My ex-husband resides in the San Diego home.
Can I change the locks on my marital home while buying my wife out?
I'm married, but my wife moved out of our home to an apartment and changed her address at the post office. I am the loan holder, but we are both on the deed. I don't want her just showing up or having access to our home anymore. She thinks she can and that I cannot change the locks and so on and she can sell it without me. I am in the process of buying her out and having her name removed from the deed; but, until then, can't I change the locks and request she not just show up or storm in? I don't have a key to her apartment.
