What amount of money would I have to pay to get my ex off of the mortgage? What are my legal options?
I am a 51 year old male who had a female partner living with me for the last six years. During that time my partner left me for another man (ex husband) for five months. She most recently deserted me due to infidelity and has been gone for the last six months.
In 2001, I purchased a vacant lot and held a construction loan in my name alone. My brother sold me the lot at a reduced price of $20K as long as I agreed to pay him back if and when I sold the house. From my own savings I put a down payment of $25K for the construction loan. When construction was completed it was necessary that my partner and I sign for the mortgage in order to quality for the loan. From the date the loan was issued I have had direct deposit from my payroll to pay the mortgage each month. For the first three years I paid the taxes and insurance. The only monies that have been paid out my partner since we have moved into the house has been to pay for half of the utilities which amounts to $24K to date or $445 a month. In comparison I have paid out $105K to date or $1950 a month. The amount of money I have paid out does not include what I have covered while she has been gone. What are my options to dissolve this relationship? What amount of money would I have to pay to her to get her off of the mortgage? What are my legal options?
What is my sister in law liable for as the attorney in fact for my mother in law?
My sister in law is an agent for my mother in law. What is she liable for financially and can she risign at any time? Who takes over if the principal is not capable?
Is there a way to force my sister into telling us where she has our mother?
My younger sister cares for my 95 year old mother who has alzheimers. She has not allowed me or my older sister to see her for about four years and now I don't even know where my mother is. Is there a way I can force her to tell me where my mother is living or if she is still living?
How do you make a Power of Attorney legally binding?
Does a Power of Attorney have to be filed with an attorney to be effective or does it just have to be filled out, signed and notarized to be in effect? This would be a Power of Attorney to handle my mother's personal business such as finances, bills, etc. while she's in the nursing home.
Another family member and I would like to act as co-agents on this Power of Attorney. Would us acting as co-agents have any affect on whether or not it would have to filed with an attorney? I understand that we would have to specify if the co-agents would have to act together or whether we could act independently of each other.
If the Power of Attorney does have to be filed with an attorney for any of the above reasons, how long does the process take from the time we consult the attorney until the Power of Attorney is legally in effect?
