Should I plead not guilty to a criminal trespass ticket?
My son and I crossed the Flathead river in a raft to reach the other side that is forest service land. We went hiking up a Mountain but we had to cross the railroad tracks to get to the mountain, we crossed back over the tracks and river a game warden was waiting and gave me a criminal trespass ticket. I did not know it was trespassing to cross the tracks, plus it was not posted, should I plead not guilty?
Can res judicata apply if I violate a municipal ordinance again?
I have previously been cited for violating a Sheridan city municipal ordinance (keeping horses less than 100' of a residence). If I violate this ordinance again and if cited again can the prosecuting attorney claim 'res-judicata' and is the burden of proof on me if I plead not guilty?
What happens after my son's lawyer was dismissed in court?
My sixteen year old son had a felony hearing 04/15/10. Before it was his turn to go in front of the judge, I accidentally overheard my assigned council and the felony D.A. in their meeting before court started. I am hearing with my own ears that my assigned council is not in my sons best interest! She was angry at our family for not following her advice, and told the D.A. to do whatever the D.A. wanted. I was frozen in shock. The D.A. says they want to keep it a felony B, (not reduce the charge to a misdemeanor) then. They leave the room to go into court. I am standing there frozen in shock at what I just over heard. Now they are up before the judge to give their recommendation or whatever is next, and I finally recover my wits, stand up and ask to come forward, tell the judge it has come to my knowledge that my sons lawyer is not acting in his best interest. He then dismisses my lawyer and postpones for one week. The D.A. spoke before closing saying she wants it on record that they want to keep this a felony charge. Now we leave court and I don't know what to do! My son is back at the holding center, I have to get another lawyer (it's Saturday!) and I am not sure what just happened! Did he just lose his chance to have the charge reduced?
Is a no contest plea better than a guilty plea for underage alcohol consumption?
A ticket issued to a 19-year old for underage alcohol consumption is the issue. Which plea is better -- 'no-contest' or 'guilty'?
What are the differences between pleading no contest and guilty?
This is my situation: I'm a college student in Tallahassee, One night I was at a party in my apt. complex. It was getting late so i decided to leave but when i arrived at my apt. I couldn't find my keys. I walked back over to the party to go look for them. When i got back i was knocking on the front door but no one could hear me because the music was blasting inside. I decided to walk around to the back doors (which are glass) to try and get someones attention inside. The first time i knocked on the glass doors, still no one heard me. The second time I banged on the door with my fist and the door shattered. I had to get stitches and the police charged me with criminal mischief over $200 under $1000. My question is: in a case like this what is the difference between pleading no contest and pleading guilty. i did not intentionally break the door. Also i was wondering what kind of punishment I might receive since this is my first offense. I decided not to hire an attorney so i would like to walk into court feeling some what knowledgeable. Also I missed my first court date because i had no idea i was supposed to appear in court. After the broken door incident i moved to another apartment complex and didn't get my mail for a long time. I turned myself in the same day as my court date as soon as I found out i had missed it. Will this complicate things in court tomorrow? Is the judge going to even ask what happened that night or is he just going to ask me how I plea to the charge?
